1 2 as amended, passed, and reprinted by the Senate, as
1 3 follows:
1 4 #1. By striking page 1, line 5, through page 6,
1 5 line 39, and inserting the following:
1 6 "Sec. . NEW SECTION. 280A.1 IOWA LEARNING
1 7 TECHNOLOGY INITIATIVE.
1 8 1. INITIATIVE. The Iowa learning technology
1 9 initiative is created to provide training and learning
1 10 opportunities to public and accredited nonpublic
1 11 school students in grade seven and their
1 12 administrators and teachers.
1 13 2. PILOT PROGRAM. The Iowa learning technology
1 14 commission created in section 280A.2 shall develop and
1 15 administer the Iowa learning technology initiative,
1 16 which shall include a pilot program. Upon the receipt
1 17 or pledge of sufficient moneys, as determined by the
1 18 commission, for deposit in the Iowa learning
1 19 technology fund created in section 280A.4, the pilot
1 20 program shall be implemented. A school district or
1 21 accredited nonpublic school may submit an application
1 22 to participate in the pilot program to the commission
1 23 no later than sixty days following receipt or pledge
1 24 of moneys into the Iowa learning technology fund. The
1 25 application shall include a written statement that
1 26 indicates a dedicated willingness to participate.
1 27 School districts or accredited nonpublic schools
1 28 chosen to participate in the pilot program shall have
1 29 demonstrated to the commission administrative
1 30 leadership, teacher willingness to participate, and
1 31 community support, and shall represent geographically
1 32 distinct rural, urban, and suburban areas of the
1 33 state. The commission shall notify applicants of
1 34 approval or disapproval of applications no later than
1 35 seventy-five days after the application deadline.
1 36 3. PUBLIC-PRIVATE PARTNERSHIP.
1 37 a. The Iowa learning technology commission shall,
1 38 in consultation with the department of education and
1 39 the department of administrative services, develop and
1 40 issue no later than forty-five days after the receipt
1 41 or pledge of moneys into the Iowa learning technology
1 42 fund, a request for proposals for one or more private
1 43 providers who shall partner with the state to
1 44 implement the pilot program phase of the initiative.
1 45 No later than forty-five days after the issuance of
1 46 the request for proposals, the commission shall select
1 47 finalists from among the proposals submitted. No
1 48 later than forty-five days after the selection of
1 49 finalists, the commission shall select one or more
1 50 private providers.
2 1 b. One or more private providers shall be selected
2 2 by the commission through a request for proposals
2 3 process for a total solutions learning technology
2 4 package that includes, but is not limited to,
2 5 hardware, software, professional development, and
2 6 service and support, which shall be managed by a
2 7 single point of contact responsible for the overall
2 8 implementation. The proposal selected by the
2 9 commission shall achieve significant efficiencies and
2 10 economies of scale, be interoperable with existing
2 11 technologies, and be consistent with the state's
2 12 economic development and education policies. In
2 13 selecting a private provider, the commission shall
2 14 consider all of the following with respect to the
2 15 private provider:
2 16 (1) Experience in the development and successful
2 17 implementation of large-scale, school-based wireless
2 18 and other learning technology projects, and the
2 19 technical ability to deliver a total solutions package
2 20 of learning technology for elementary and secondary
2 21 students and teachers.
2 22 (2) Demonstrated financial capability and long-
2 23 term stability to partner with the state over the term
2 24 of the private provider contract.
2 25 (3) Expertise, experience, and capabilities in
2 26 education practice and evaluation methods.
2 27 c. The commission shall conduct, in cooperation
2 28 with the attorney general, contract negotiations to
2 29 establish a public-private partnership on behalf of
2 30 the commission and enter into a contract negotiated
2 31 with one or more private providers to establish a
2 32 four-year learning technology pilot program to provide
2 33 a wireless laptop computer to each student, teacher,
2 34 and relevant administrator in a participating school
2 35 and implement the use of software, on-line courses,
2 36 and other appropriate learning technologies that have
2 37 been shown to improve academic achievement and
2 38 specified progress measures. The term of the contract
2 39 shall include the deployment of computers to students
2 40 and teachers in participating school districts and
2 41 accredited nonpublic schools in accordance with
2 42 subsection 2.
2 43 4. EVALUATION. To measure the effectiveness of
2 44 the pilot program established pursuant to subsection
2 45 2, the Iowa learning technology commission shall, at a
2 46 minimum, establish standards and methods of measuring
2 47 progress in the areas of increased student engagement,
2 48 decreased disciplinary problems, increased use of
2 49 computers for writing, analysis, and research,
2 50 movement toward student-centered classrooms, increased
3 1 parental involvement, and increases in standardized
3 2 test scores. The commission shall work cooperatively
3 3 with the department of education and the state board
3 4 of regents in establishing an evaluation process
3 5 pursuant to this subsection.
3 6 Sec. . NEW SECTION. 280A.2 COMMISSION
3 7 MEMBERS.
3 8 1. COMMISSION CREATED. An Iowa learning
3 9 technology commission is created to establish the
3 10 policies and determine the necessary budget for
3 11 implementation of the Iowa learning technology
3 12 initiative.
3 13 2. MEMBERS. The commission shall initially be
3 14 appointed no later than July 1, 2004, and shall
3 15 consist of eighteen members appointed as follows:
3 16 a. Nine voting members who shall be members of the
3 17 general public and shall be appointed as follows:
3 18 (1) Two members shall be appointed by the
3 19 governor.
3 20 (2) Two members shall be appointed by the
3 21 president of the senate.
3 22 (3) One member shall be appointed by the minority
3 23 leader of the senate.
3 24 (4) Two members shall be appointed by the speaker
3 25 of the house of representatives.
3 26 (5) One member shall be appointed by the minority
3 27 leader of the house of representatives.
3 28 (6) One member who is a member of the state board
3 29 of education shall be appointed by the chairperson of
3 30 the state board.
3 31 b. Nine ex officio, nonvoting members who shall be
3 32 appointed as follows:
3 33 (1) One member representing public postsecondary
3 34 education institutions who is employed by a public
3 35 postsecondary education institution shall be appointed
3 36 by the governor.
3 37 (2) Three members representing three different
3 38 school districts shall be appointed by the governor as
3 39 follows:
3 40 (a) One member shall be a teacher employed by a
3 41 school district or area education agency who is
3 42 appointed from a list of three names submitted by a
3 43 certified employee organization representing teachers
3 44 licensed under chapter 272.
3 45 (b) One member shall be an administrator employed
3 46 by a school district who is appointed from a list of
3 47 three names submitted by a statewide organization
3 48 representing administrators licensed under chapter
3 49 272.
3 50 (c) One member shall be a member of a board of
4 1 directors of a school district who is appointed by a
4 2 statewide organization representing school boards.
4 3 (3) One member representing area education
4 4 agencies shall be appointed by the governor from a
4 5 list of three names submitted by area education agency
4 6 administrators.
4 7 (4) One member who is a member of the senate shall
4 8 be appointed by the president of the senate.
4 9 (5) One member who is a member of the senate shall
4 10 be appointed by the minority leader of the senate.
4 11 (6) One member who is a member of the house of
4 12 representatives shall be appointed by the speaker of
4 13 the house of representatives.
4 14 (7) One member who is a member of the house of
4 15 representatives shall be appointed by the minority
4 16 leader of the house.
4 17 3. EXPERIENCE AND SPECIAL KNOWLEDGE. In
4 18 appointing members to the commission, proper
4 19 consideration shall be given to persons with
4 20 experience or special knowledge in one or more of the
4 21 following areas: education, business, economic
4 22 development, technology, and finance.
4 23 4. BALANCE. Commission members shall be appointed
4 24 in compliance with sections 69.16 and 69.16A.
4 25 Appointments of public members shall be made to
4 26 provide broad representation of the various
4 27 geographical areas of the state insofar as possible.
4 28 5. CHAIRPERSONS. The commission shall elect a
4 29 chairperson and a vice chairperson annually from among
4 30 the voting members of the commission. A member shall
4 31 not serve as a chairperson or vice chairperson for
4 32 more than three consecutive years.
4 33 6. MEETINGS. The commission shall meet at least
4 34 three times each year.
4 35 7. QUORUM. A majority of the voting members
4 36 constitutes a quorum for the transaction of any
4 37 official business.
4 38 8. TERMS OF MEMBERS. The members shall be
4 39 appointed to three-year staggered terms and the terms
4 40 shall commence and end as provided by section 69.19.
4 41 If a vacancy occurs, a successor shall be appointed to
4 42 serve the unexpired term. A successor shall be
4 43 appointed in the same manner and subject to the same
4 44 qualifications as the original appointment to serve
4 45 the unexpired term.
4 46 9. EXPENSES. Members of the commission are
4 47 entitled to receive reimbursement for actual expenses
4 48 incurred while engaged in the performance of official
4 49 duties from the Iowa learning technology fund created
4 50 in section 280A.4, except that legislators' expenses
5 1 shall be paid from funds appropriated by section 2.12.
5 2 Sec. . NEW SECTION. 280A.3 COMMISSION PLAN
5 3 GUIDING PRINCIPLES.
5 4 1. The Iowa learning technology commission created
5 5 in section 280A.2 shall develop a learning technology
5 6 plan to achieve the goal of preparing students for an
5 7 economy that is increasingly dependent on technology
5 8 and innovation. The commission shall examine the use
5 9 of technology in Iowa's and the nation's elementary
5 10 and secondary classrooms.
5 11 2. The plan developed by the commission shall
5 12 include, but not be limited to, the following:
5 13 a. The costs and benefits of each component of the
5 14 plan.
5 15 b. The professional development needed to
5 16 integrate learning technology into classroom
5 17 technology.
5 18 c. Strategies for implementation of the plan,
5 19 including, at a minimum, phasing in the plan over a
5 20 term of years.
5 21 d. Strategies that coordinate the learning
5 22 technology in kindergarten through grade twelve with
5 23 the initiatives and resources of the department of
5 24 education, Iowa communications network, area education
5 25 agencies, higher education institutions providing
5 26 approved practitioner preparation programs, and other
5 27 accredited postsecondary institutions in the state.
5 28 e. Procedures for data tracking and assessment of
5 29 the progress in implementing the goals of the
5 30 initiative and the plan.
5 31 f. Strategies to establish a public-private
5 32 partnership between state government and a private
5 33 sector business having relevant knowledge and
5 34 experience.
5 35 3. The plan shall be consistent with the following
5 36 guiding principles:
5 37 a. The plan shall promote equal opportunity for
5 38 and provide meaningful access to wireless and other
5 39 learning technology resources for all Iowa students
5 40 regardless of geographic location or economic means.
5 41 b. The plan shall support student achievement
5 42 through the integration of learning technologies that
5 43 are content-focused and that add value to existing
5 44 instructional methods.
5 45 c. The plan shall provide for the future
5 46 sustainability of learning technology resources by
5 47 adapting to future educational needs and technological
5 48 changes.
5 49 d. The plan shall provide professional development
5 50 and training programs for administrators, teachers and
6 1 other educators in the use and integration of learning
6 2 technology tools in curriculum development,
6 3 instructional methods, and student assessment systems.
6 4 e. The plan shall foster economic development
6 5 across all regions of the state and the preparation of
6 6 students for an economy that embraces technology and
6 7 innovation.
6 8 4. The plan shall be submitted to the general
6 9 assembly on or before December 15, 2004.
6 10 Sec. . NEW SECTION. 280A.4 FUND.
6 11 1. An Iowa learning technology fund is created in
6 12 the state treasury. The fund shall consist of moneys
6 13 including, but not limited to, moneys in the form of a
6 14 devise, gift, bequest, donation, federal or other
6 15 grant, reimbursement, repayment, judgment, transfer,
6 16 payment, or appropriation from any source intended to
6 17 be used for the purposes of the fund.
6 18 2. Moneys in the fund are appropriated to the Iowa
6 19 learning technology commission created in section
6 20 280A.2 for purposes of an Iowa learning technology
6 21 initiative created pursuant to section 280A.1. Moneys
6 22 in the fund shall not be subject to appropriation for
6 23 any other purpose by the general assembly. However,
6 24 moneys in the fund may be used for necessary audit
6 25 services, legal expenses, investment management fees
6 26 and services, and general administrative expenses
6 27 related to the management and administration of the
6 28 Iowa learning technology initiative.
6 29 3. Moneys in the fund are not subject to section
6 30 8.33. Notwithstanding section 12C.7, subsection 2,
6 31 interest or earnings on moneys deposited in the fund
6 32 shall be credited to the fund.
6 33 4. The fund shall be administered by the
6 34 commission, which shall make expenditures from the
6 35 fund consistent with the purposes of the initiative
6 36 without further appropriation. The fund shall be
6 37 administered in a manner that provides for the
6 38 financially sustainable support, use, and integration
6 39 of learning technology in Iowa schools through a
6 40 public-private partnership. Expenditures from the
6 41 fund shall be made consistent with the purposes of the
6 42 Iowa learning technology initiative to ensure one-to-
6 43 one access to and ubiquitous use of fully configured
6 44 laptop computers in grade seven in public and
6 45 accredited nonpublic school classrooms located
6 46 initially in a number of school districts and
6 47 accredited nonpublic schools in Iowa as determined by
6 48 the Iowa learning technology commission.
6 49 Sec. . NEW SECTION. 280A.5 REPEAL.
6 50 This chapter is repealed effective July 1, 2009.""
