1 4 "Sec. . Section 8.57, subsection 5, Code
1 5 Supplement 2003, is amended by adding the following
1 6 new paragraph:
1 7 NEW PARAGRAPH. g. Notwithstanding any other
1 8 provision to the contrary, and prior to the
1 9 appropriation of moneys from the rebuild Iowa
1 10 infrastructure fund pursuant to paragraph "c", and
1 11 section 8.57A, subsection 4, moneys shall first be
1 12 appropriated from the rebuild Iowa infrastructure fund
1 13 to the vertical infrastructure fund as provided in
1 14 section 8.57B, subsection 4.
1 15 Sec. . NEW SECTION. 8.57B VERTICAL
1 16 INFRASTRUCTURE FUND.
1 17 1. A vertical infrastructure fund is created under
1 18 the authority of the department of management. The
1 19 fund shall consist of appropriations made to the fund
1 20 and transfers of interest, earnings, and moneys from
1 21 other funds as provided by law. The fund shall be
1 22 separate from the general fund of the state and the
1 23 balance in the fund shall not be considered part of
1 24 the balance of the general fund of the state.
1 25 However, the fund shall be considered a special
1 26 account for the purposes of section 8.53, relating to
1 27 generally accepted accounting principles.
1 28 2. Notwithstanding section 12C.7, subsection 2,
1 29 interest or earnings on moneys in the vertical
1 30 infrastructure fund shall be credited to the rebuild
1 31 Iowa infrastructure fund.
1 32 3. Moneys in the fund in a fiscal year shall be
1 33 used as appropriated by the general assembly for
1 34 public vertical infrastructure projects. For the
1 35 purposes of this section, "vertical infrastructure"
1 36 includes only land acquisition and construction, major
1 37 renovation, and major repair of buildings, all
1 38 appurtenant structures, utilities, and site
1 39 development. "Vertical infrastructure" does not
1 40 include routine, recurring maintenance, debt service,
1 41 or operational expenses or leasing of a building,
1 42 appurtenant structure, or utility without a lease-
1 43 purchase agreement.
1 44 4. There is appropriated from the rebuild Iowa
1 45 infrastructure fund to the vertical infrastructure
1 46 fund, the following:
1 47 a. For the fiscal year beginning July 1, 2005, and
1 48 ending June 30, 2006, the sum of twenty-five million
1 49 dollars.
1 50 b. For the fiscal year beginning July 1, 2006, and
2 1 ending June 30, 2007, the sum of fifty million
2 2 dollars.
2 3 c. For the fiscal year beginning July 1, 2007, and
2 4 ending June 30, 2008, the sum of seventy-five million
2 5 dollars.
2 6 d. For the fiscal year beginning July 1, 2008, and
2 7 each fiscal year thereafter, the sum of one hundred
2 8 million dollars."
