1 1 Amend the amendment, H-8418, to Senate File 2298,
1 2 as amended, passed, and reprinted by the Senate, as
1 3 follows:
1 4 #1. Page 3, by striking lines 38 through 46 and
1 5 inserting the following:
1 6 "NEW SUBSECTION. 4. Notwithstanding any provision
1 7 of this section and sections 8.33 and 8.39 to the
1 8 contrary, if a full-time equivalent position budgeted
1 9 for within an appropriation from the general fund of
1 10 the state to a department or establishment other than
1 11 the state board of regents is vacant for all or a
1 12 portion of the fiscal year, an amount equal to the
1 13 salary and benefits associated with the time of
1 14 vacancy of the position shall be considered to be
1 15 encumbered for the period of the vacancy, shall not be
1 16 used for any other purpose, and the encumbered amount
1 17 shall revert to the general fund of the state at the
1 18 close of the fiscal year."
1 19 #2. Page 6, by inserting after line 36 the
1 20 following:
1 21 "# . Page 199, by inserting after line 34 the
1 22 following:
1 23 "Sec. ___. UNFILLED VACANCIES STATE BOARD OF
1 24 REGENTS. The state board of regents shall report on
1 25 the policies of the institutions under the authority
1 26 of the state board for addressing the budget
1 27 ramifications associated with unfilled vacant
1 28 positions. If a policy does not exist, the state
1 29 board shall provide for implementation of such a
1 30 policy and report concerning the policy to the
1 31 government oversight committees of the senate and
1 32 house of representatives. The report shall be
1 33 submitted on or before December 15, 2004.""
