A school district 2 5 shall receive one thousand three hundred dollars per 2 6 beginning teacher participating in the program. If 2 7 the funds appropriated for the program are 2 8 insufficient to pay mentors and school districts as 2 9 provided in this paragraph, the department shall 2 10 prorate the amount distributed to school districts 2 11 based upon the amount appropriated. Moneys received 2 12 by a school district pursuant to this paragraph shall 2 13 be expended to provide each mentor with an award of 2 14 five hundred dollars per semester, at a minimum, for 2 15 participation in the school district's beginning 2 16 teacher mentoring and induction program; to implement 2 17 the plan; and to pay any applicable costs of the 2 18 employer's share of contributions to federal social 2 19 security and the Iowa public employees' retirement 2 20 system or a pension and annuity retirement system 2 21 established under chapter 294, for such amounts paid 2 22 by the district." 2 23 #10. A portion of the funds allocated to the 2 26 department for purposes of this paragraph may be used 2 27 by the department for administrative purposes." 2 28 #11. Section 294A.22, Code Supplement 2003, 2 47 is amended by adding the following new unnumbered 2 48 paragraph: 2 49 NEW UNNUMBERED PARAGRAPH. If funds appropriated 2 50 are insufficient to pay phase II allocations in full, 3 1 the department of administrative services shall 3 2 prorate payments to school districts and area 3 3 education agencies. 3 4 Sec. ___. Notwithstanding any provision 3 39 of this section and section 8.39 to the contrary, if a 3 40 full-time equivalent position funded with an 3 41 appropriation from the general fund of the state 3 42 remains vacant for a period of at least forty-five 3 43 days, the agency to which the appropriation was made 3 44 shall revert to the general fund of the state at the 3 45 close of the fiscal year the salary and benefits cost 3 46 of that position for the period of the vacancy." 3 47 #22. Page 181, by inserting after line 15 the 3 48 following: 3 49 "Sec. . Section 35A.2, Code 2003, is amended to 3 50 read as follows: 4 1 35A.2 COMMISSION OF VETERANS AFFAIRS. 4 2 1. A commission of veterans affairs is created 4 3 consisting ofsevennine persons who shall be 4 4 appointed by the governor, subject to confirmation by 4 5 the senate. Members shall be appointed to staggered 4 6 terms of four years beginning and ending as provided 4 7 in section 69.19. The governor shall fill a vacancy 4 8 for the unexpired portion of the term. 4 9 2. Six commissioners shall be honorably discharged 4 10 members of the armed forces of the United States. The 4 11 American legion of Iowa, disabled American veterans 4 12 department of Iowa, veterans of foreign wars 4 13 department of Iowa, American veterans of World War II, 4 14 Korea, and Vietnam, the Vietnam veterans of America, 4 15 and the military order of the purple heart, through 4 16 their department commanders, shall submit two names 4 17 respectively from their organizations to the governor. 4 18 The governor shall appoint from each of the 4 19 organizations one representative to serve as a member 4 20 of the commission, unless the appointments would 4 21 conflict with the bipartisan and gender balance 4 22 provisions of sections 69.16 and 69.16A. In addition, 4 23 the governor shall appointone memberthree members of 4 24 the public, knowledgeable in the general field of 4 25 veterans affairs, to serve on the commission." 4 26 #23. Page 182, by inserting after line 2 the 4 27 following: 4 28 "Sec. . Section 35D.13, subsection 2, Code 4 29 2003, is amended by striking the subsection and 4 30 inserting in lieu thereof the following: 4 31 2. The commandant shall be a licensed nursing home 4 32 administrator." 4 33 #24. Page 182, by inserting after line 12 the 4 34 following: 4 35 "Sec. . Section 135C.31A, Code Supplement 2003, 4 36 is amended to read as follows: 4 37 135C.31A ASSESSMENT OF RESIDENTS PROGRAM 4 38 ELIGIBILITY. 4 39 Beginning July 1, 2003, a health care facility 4 40 receiving reimbursement through the medical assistance 4 41 program under chapter 249A shall assist the Iowa 4 42 commission of veterans affairs in identifying, upon 4 43 admission of a resident, the resident's eligibility 4 44 for benefits through the federal department of 4 45 veterans affairs. The health care facility shall also 4 46 assist the Iowa commission of veterans affairs in 4 47 determining such eligibility for residents residing in 4 48 the facility on July 1, 2003. The department of 4 49 inspections and appeals, in cooperation with the 4 50 department of human services, shall adopt rules to 5 1 administer this section, including a provision that 5 2 ensures that if a resident is eligible for benefits 5 3 through the federal department of veterans affairs or 5 4 other third-party payor, the payor of last resort for 5 5 reimbursement to the health care facility is the 5 6 medical assistance program. This section shall not 5 7 apply to the admission of an individual to a state 5 8 mental health institute for acute psychiatric care or 5 9 to the admission of an individual to the Iowa veterans 5 10 home." 5 11 #25. Page 186, by striking lines 5 through 8 and 5 12 inserting the following: "meets at least one of the 5 13 criteria in paragraphs "a" through "c" and all of the 5 14 criteria in paragraphs "d" through "g":" 5 15 #26. Submit annually to the 5 29 department of education data regarding the salaries 5 30 and benefits of administrators and from the most 5 31 recent". 5 32 #30. Page 187, by striking lines 21 and 22 and 5 33 inserting the following: "board shall submit annually 5 34 to the department of education data regarding the 5 35 salaries and benefits of administrators and from the 5 36 most recent contract". 5 37 #31. Page 194, line 2, by inserting after the word 5 38 "materials," the following: "and after consultation 5 39 with the public water supply and consideration of all 5 40 applicable rules relating to remediation,". 5 41 #32. Page 194, lines 9 and 10, by striking the 5 42 words "are made available" and inserting the 5 43 following: "do not impose a financial obligation on 5 44 the part of the public water supply. Funds available 5 45 to or provided by the public water supply may be used 5 46 for system improvements made in conjunction with 5 47 replacement of the source". 5 48 #33. Page 194, by striking lines 15 through 17 and 5 49 inserting the following: "standards. Nothing in this 5 50 paragraph shall affect the public water supply's right 6 1 to pursue recovery from a responsible party." 6 2 #34. Page 199, by inserting after line 27 the 6 3 following: 6 4 "Sec. . 2003 Iowa Acts, chapter 178, section 6 5 28, unnumbered paragraph 3, is amended to read as 6 6 follows: 6 7 Notwithstanding section 8.64, subsection 4, as 6 8 enacted by this division of this Act, the local 6 9 government innovation fund committee may provideup to6 1020 percent of theany amount appropriated in this 6 11 section in the form of forgivable loans or as grants 6 12 for those projects that propose a new and innovative 6 13 sharing initiative that would serve as an important 6 14 model for cities and counties. 6 15 Sec. . Notwithstanding section 8.33, moneys 6 16 appropriated in 2003 Iowa Acts, chapter 178, section 6 17 62, and 2003 Iowa Acts, chapter 181, section 11, 6 18 subsection 3, which remain unencumbered or unobligated 6 19 at the close of the fiscal year beginning July 1, 6 20 2003, shall not revert but shall remain available for 6 21 expenditure for the purposes for which they were 6 22 appropriated for the fiscal year beginning July 1, 6 23 2004." 6 24 #35. Page 199, by inserting after line 34 the 6 25 following: 6 26 "Sec. . 2003 Iowa Acts, First Extraordinary 6 27 Session, chapter 2, section 4, unnumbered paragraph 3, 6 28 is amended to read as follows: 6 29 Notwithstanding section 8.64, subsection 4, if 6 30 enacted by 2003 Iowa Acts, Senate File 453, section 6 31 27, the local government innovation fund committee may 6 32 provideup to 20 percent of theany amount 6 33 appropriated in this section in the form of forgivable 6 34 loans or as grants for those projects that propose a 6 35 new and innovative sharing initiative that would serve 6 36 as an important model for cities and counties." 6 37 #36. Page 204, by inserting after line 16 the 6 38 following: 6 39 "Sec. . APPOINTMENTS. The new appointees to 6 40 the commission of veterans affairs, pursuant to the 6 41 increase in the membership of the commission as 6 42 provided in this division of this Act, shall be 6 43 appointed by the governor, with one member being 6 44 appointed for an initial term of two years and one 6 45 member being appointed for an initial term of four 6 46 years." 6 47 #37.
