1 1 Amend the amendment, H-8366, to Senate File 2269,
1 2 as passed by the Senate, as follows:
1 3 #1. Page 1, by inserting after line 2, the
1 4 following:
1 5 "# . Page 1, by inserting before line 1, the
1 6 following:
1 7 "Section 1. Section 39A.2, subsection 1, paragraph
1 8 b, subparagraph (1), Code 2003, is amended to read as
1 9 follows:
1 10 (1) Destroys, delivers, or handles an application
1 11 for a ballot or an absentee ballot with the intent of
1 12 interfering with the voter's right to vote, except as
1 13 otherwise provided in section 53.17, subsection 4.
1 14 Sec. 2. Section 39A.3, subsection 1, paragraph a,
1 15 Code 2003, is amended by adding the following new
1 16 subparagraph:
1 17 NEW SUBPARAGRAPH. (4) Violates any part of
1 18 section 53.17, subsection 4.""
1 19 #2. Page 2, by striking lines 46 through 48, and
1 20 inserting the following: "election misconduct in the
1 21 second degree, pursuant to section 39A.3, subsection
1 22 1, paragraph "a", subparagraph (4)."
1 23 #3. By renumbering as necessary.
