1 1 Amend the amendment, H-1357, to Senate File 422, as
1 2 amended, passed, and reprinted by the Senate, as
1 3 follows:
1 4 #1. Page 1, by inserting after line 3 the
1 5 following:
1 6 "# . Page 2, by inserting after line 12, the
1 7 following:
1 8 "Sec. . NEW SECTION. 321J.2C PERSONS FOUND
1 9 NOT GUILTY.
1 10 1. Notwithstanding any other provision of this
1 11 chapter to the contrary, if any prosecution for a
1 12 violation of section 321J.2 or 321J.2A does not result
1 13 in a conviction, and the defendant's driver's license
1 14 or nonresident operating privilege has been revoked
1 15 under section 321J.12 for the occurrence from which
1 16 the arrest arose, the department shall, upon receipt
1 17 of the court order finding the defendant not guilty,
1 18 immediately rescind the revocation order and reinstate
1 19 the defendant's license.
1 20 2. Notwithstanding section 321.12 or any other
1 21 provision of chapter 321 or 321J to the contrary, the
1 22 director shall immediately destroy any operating
1 23 records pertaining to a revocation under section
1 24 321J.12 for the occurrence from which an arrest arose
1 25 when the defendant was subsequently prosecuted and
1 26 found not guilty upon receipt of the court order
1 27 finding the defendant not guilty.""
1 28 #2. Page 1, by inserting after line 13 the
1 29 following:
1 30 "# . Title page, line 1, by inserting before the
1 31 word "procedure" the following: "administrative"."
1 32 #3. Page 1, line 15 by inserting after the word
1 33 "substances" the following: ", by reinstating a
1 34 driver's license upon a finding of not guilty in an
1 35 operating-while-intoxicated offense,".
