1 1 Amend the amendment, H-1191, to Senate File 390, as
1 2 amended, passed, and reprinted by the Senate, as
1 3 follows:
1 4 #1. Page 1, by inserting after line 33, the
1 5 following:
1 6 "# . Page 21, by inserting after line 23, the
1 7 following:
1 8 "Sec. . Section 331.303, Code 2003, is amended
1 9 by adding the following new subsection:
1 10 NEW SUBSECTION. 8A. Upon petition of twenty
1 11 percent of the eligible electors residing in the area
1 12 outside the city limits over which the zoning
1 13 jurisdiction is extended, approve or disapprove
1 14 pursuant to section 414.23 a city zoning ordinance or
1 15 regulation or an amendment to such an ordinance or
1 16 regulation affecting such area."
1 17 # . Page 22, by inserting after line 2, the
1 18 following:
1 19 "Sec. . Section 414.23, unnumbered paragraph 3,
1 20 Code 2003, is amended to read as follows:
1 21 Property owners affected by such zoning regulations
1 22 shall have the same rights of hearing, protest, and
1 23 appeal as those within the municipality exercising
1 24 this power. However, upon petition of twenty percent
1 25 of the eligible electors residing in the area outside
1 26 the city limits over which the zoning jurisdiction is
1 27 extended, the city zoning ordinance or regulation, or
1 28 amendment to such an ordinance or regulation, shall
1 29 not take effect within such area unless the zoning
1 30 ordinance or regulation, or the amendment to such an
1 31 ordinance or regulation, is approved by the board of
1 32 supervisors. The petition shall be submitted to the
1 33 county auditor. The auditor shall notify the city of
1 34 receipt of the petition."
1 35 # . Page 22, line 8, by inserting after the word
1 36 "Act" the following: "and applies to a city zoning
1 37 ordinance or regulation or an amendment to a city
1 38 ordinance or regulation affecting an unincorporated
1 39 area of a county over which a city has extended its
1 40 jurisdiction, which is adopted on or after the
1 41 effective date of this Act".
1 42 # . Title page, line 10, by inserting after the
1 43 word "committees," the following: "authorizing a
1 44 county board of supervisors to approve or disapprove
1 45 certain city zoning ordinances or regulations,".
