  1  1    Section 1.  Section 481A.1, subsection 19, Code 2001, is
  1  2 amended to read as follows:
  1  3    19.  "Fur-bearing animals" means the following which are
  1  4 declared to be fur-bearing animals for the purpose of
  1  5 regulation and protection under the Code:  beaver, badger,
  1  6 black bear, mountain lion, mink, otter, muskrat, raccoon,
  1  7 skunk, opossum, spotted skunk or civet cat, weasel, coyote,
  1  8 bobcat, wolf, groundhog, red fox, and gray fox.  This chapter
  1  9 does not apply to domesticated fur-bearing animals.
  1 10    Sec. 2.  Section 482.12, subsection 1, unnumbered paragraph
  1 11 1, Code Supplement 2001, is amended to read as follows:
  1 12    A person shall not take, possess, or sell freshwater
  1 13 mussels from the waters of the state without an appropriate a
  1 14 commercial mussel license.
  1 15    Sec. 3.  Section 482.12, subsection 1, paragraphs a and b,
  1 16 Code Supplement 2001, are amended by striking the paragraphs.
  1 17    Sec. 4.  Section 482.12, subsection 2, Code Supplement
  1 18 2001, is amended to read as follows:
  1 19    2.  A person holding a commercial mussel fisher license may
  1 20 take all species of freshwater mussels, or their parts, except
  1 21 where otherwise prohibited by rules of the commission.  
  1 22                           EXPLANATION
  1 23    This bill adds black bear and mountain lion to the
  1 24 definition of "fur-bearing animal" for the purpose of
  1 25 protection and regulation by the department of natural
  1 26 resources.
  1 27    The bill also prohibits the taking of mussels with a sport
  1 28 fishing license.  Only persons holding commercial mussel
  1 29 licenses shall take, possess, or sell freshwater mussels in
  1 30 this state.
