1 1 Section 1. NEW SECTION. 728.5A ADULT ARCADES.
1 2 1. A place of business or establishment required to obtain
1 3 a sales tax permit which operates an adult arcade shall not be
1 4 open for business between the hours of ten p.m. and ten a.m.
1 5 2. For purposes of this section an "adult arcade" means a
1 6 business or establishment that holds itself out to be
1 7 primarily in the business of offering persons the capacity to
1 8 view for a fee still pictures, film, or videos in a private
1 9 viewing room designed for five persons or less, where images
1 10 are depicted that place an emphasis on showing a person in a
1 11 state of full or partial nudity or otherwise involved in a sex
1 12 act. An adult arcade does not include a hotel or motel room.
1 13 Sec. 2. Section 728.8, Code 2001, is amended to read as
1 14 follows:
1 15 728.8 SUSPENSION OF LICENSES OR PERMITS.
1 16 Any person who knowingly permits a violation of section
1 17 728.2, 728.3, or 728.5, subsection 6, to occur on premises
1 18 under the person's control shall have all permits and licenses
1 19 issued to the person under state or local law as a
1 20 prerequisite for doing business on such premises revoked for a
1 21 period of six months. A violation of section 728.5A by a
1 22 business shall result in the suspension of the sales tax
1 23 permit of the business for a period of six months. The county
1 24 attorney shall notify all agencies responsible for issuing
1 25 licenses and permits of any conviction under section 728.2,
1 26 728.3, or 728.5, subsection 6, or any violation of section
1 27 728.5A.
1 28 EXPLANATION
1 29 This bill restricts the hours an adult arcade may be open
1 30 for business.
1 31 The bill provides that a business required to obtain a
1 32 sales tax permit which operates an adult arcade may not be
1 33 open for business between the hours of 10 p.m. and 10 a.m.
1 34 The bill defines an adult arcade as a business or
1 35 establishment that holds itself out to be primarily in the
2 1 business of offering persons for a fee the capacity to view
2 2 still pictures or videos in a private viewing room designed
2 3 for five persons or less, where images are depicted that place
2 4 an emphasis on showing a person in a state of full or partial
2 5 nudity or otherwise involved in a sex act. An adult arcade
2 6 does not include a hotel or motel room.
2 7 The bill provides that a business which violates this bill
2 8 shall have the sales tax permit of the business suspended for
2 9 a period of six months. The county attorney is responsible
2 10 for notifying agencies responsible for issuing licenses and
2 11 permits of a violation of the new provision.
