  1  1    Section 1.  Section 473.20, subsection 1, Code 2001, is
  1  2 amended to read as follows:
  1  3    1.  The department may make loans to the state, state
  1  4 agencies, political subdivisions of the state, school
  1  5 districts, area education agencies, community colleges, and
  1  6 nonprofit organizations for implementation of energy
  1  7 conservation measures identified in a comprehensive
  1  8 engineering analysis.  Loans shall not be made for energy
  1  9 conservation measures that require more than an average of six
  1 10 years for the state, state agency, political subdivision of
  1 11 the state, school district, area education agency, community
  1 12 college, or nonprofit organization as an entity to recoup the
  1 13 actual or projected cost of construction and acquisition of
  1 14 the improvements; and cost of the engineering plans and
  1 15 specifications be made for all cost effective energy
  1 16 management improvements.  For the state, state agencies,
  1 17 political subdivisions of the state, school districts, area
  1 18 education agencies, community colleges, and nonprofit
  1 19 organizations to receive a loan from the fund, the department
  1 20 shall require completion of an energy management plan
  1 21 including an energy audit and a comprehensive engineering
  1 22 analysis.  The department shall approve loans made under this
  1 23 section.  
  1 24                           EXPLANATION
  1 25    This bill amends a provision of the energy loan fund
  1 26 administered by the department of natural resources.  Out of
  1 27 the fund, the department makes loans to the state, state
  1 28 agencies, political subdivisions, school districts, area
  1 29 education agencies, community colleges, and nonprofit
  1 30 organizations for implementing energy conservation measures
  1 31 identified in a comprehensive engineering analysis.
  1 32    The bill strikes language requiring recoupment of energy
  1 33 conservation costs within an average of six years and provides
  1 34 that a loan shall be made for all cost effective management
  1 35 improvements.
