1 1 Section 1. Section 321.231, Code 2001, is amended by
1 2 adding the following new subsection:
1 3 NEW SUBSECTION. 4A. The driver of a police vehicle may
1 4 disregard laws or regulations governing the use of lighting
1 5 equipment on a vehicle when the driver's official duties so
1 6 require.
1 7 EXPLANATION
1 8 This bill amends Code section 321.231 to provide that the
1 9 driver of a police vehicle may disregard vehicle lighting
1 10 requirements when the person's official duties so require.
1 11 Currently, Code section 321.231 provides that drivers of
1 12 authorized emergency vehicles may disregard laws and
1 13 regulations governing the parking and standing of vehicles,
1 14 direction of movement, speed limits, and certain other
1 15 provisions in the course of their official duty. Code section
1 16 321.231 provides that the exceptions for the drivers of such
1 17 vehicles shall not relieve the drivers from the duty to drive
1 18 with due regard for the safety of all persons or protect the
1 19 drivers from the consequences of the drivers' reckless
1 20 disregard for the safety of others.
