1 1 Section 1. Section 88.14, Code 2001, is amended by adding
1 2 the following new subsection:
1 3 NEW SUBSECTION. 3A. VIOLATIONS CAUSING OR CONTRIBUTING TO
1 4 EMPLOYEE DEATH. If an employer has received a citation for
1 5 one or more violations of the requirements of section 88.4, of
1 6 any standard, rule, or order adopted or issued pursuant to
1 7 section 88.5, or of rules adopted pursuant to this chapter,
1 8 and the violation or violations caused or contributed to the
1 9 death of an employee, the employer shall be assessed a civil
1 10 penalty of not less than fifty thousand dollars,
1 11 notwithstanding any other provision of this section.
1 12 EXPLANATION
1 13 This bill provides that an employer who commits one or more
1 14 occupational safety and health standards violations which
1 15 cause or contribute to the death of an employee shall be
1 16 assessed a minimum civil penalty of not less than $50,000.
