1 1 Section 1. Section 562A.9, Code 2001, is amended by adding
1 2 the following new subsection:
1 3 NEW SUBSECTION. 5. A landlord shall have good cause to
1 4 terminate a rental agreement. Good cause shall constitute a
1 5 material noncompliance by the tenant with the rental
1 6 agreement, a violation of this chapter, or a legitimate
1 7 business reason.
1 8 Sec. 2. Section 562B.10, subsection 4, Code 2001, is
1 9 amended to read as follows:
1 10 4. Rental agreements shall be for a term of one year
1 11 unless otherwise specified in the rental agreement. Rental
1 12 agreements shall be canceled by at least sixty days' written
1 13 notice given by either party. A notice to cancel under this
1 14 section initiated by the landlord shall be for good cause.
1 15 Good cause shall constitute a material noncompliance by the
1 16 tenant with the rental agreement, a violation of this chapter,
1 17 or a legitimate business reason. A landlord shall not cancel
1 18 a rental agreement solely for the purpose of making the
1 19 tenant's mobile home space available for another mobile home.
1 20 EXPLANATION
1 21 This bill provides that a landlord must have good cause
1 22 before terminating a residential rental agreement or a mobile
1 23 home space rental agreement. "Good cause" is defined to mean
1 24 a material noncompliance by the tenant with the rental
1 25 agreement, a violation of this chapter, or a legitimate
1 26 business reason.
