1 1 Section 1. NEW SECTION. 622.10B BENEVOLENT GESTURES.
1 2 1. The portion of statements, writings, or benevolent
1 3 gestures limited to expressing sympathy or a general sense of
1 4 benevolence relating to the pain, suffering, or death of a
1 5 person involved in an accident and made to that person or to a
1 6 family member of that person shall be inadmissible as evidence
1 7 of an admission of liability in a civil action. A statement
1 8 of fault or an admission against interest, however, which is
1 9 part of, or in addition to, any of the above shall not be
1 10 inadmissible pursuant to this section.
1 11 2. For purposes of this section:
1 12 a. "Accident" means an occurrence resulting in injury or
1 13 death to a person which is not the result of a willful action
1 14 by a party.
1 15 b. "Benevolent gestures" means an action which conveys a
1 16 sense of compassion or commiseration emanating from humane
1 17 impulses.
1 18 c. "Family member" means the spouse, parent, grandparent,
1 19 stepparent, child, grandchild, brother, sister, half brother,
1 20 half sister, or parent-in-law.
1 21 EXPLANATION
1 22 This bill provides that the portion of statements,
1 23 writings, or benevolent gestures limited to expressing
1 24 sympathy or benevolence made to a person or to a family member
1 25 of a person involved in an accident are inadmissible as
1 26 evidence of admission of liability in a civil action. The
1 27 bill provides definitions of "accident", "benevolent
1 28 gestures", and "family member" for the purposes of the bill.
