1 1 Section 1. Section 124.302, subsection 1, Code 2001, is
1 2 amended to read as follows:
1 3 1. Every person who manufactures, distributes, or
1 4 dispenses any controlled substance within this state or who
1 5 proposes to engage in the manufacture, distribution, or
1 6 dispensing of any controlled substance within this state,
1 7 shall obtain and maintain a biennial registration issued by
1 8 the board in accordance with its rules. However, a health
1 9 care provider, a hospital as defined in section 135B.1, or a
1 10 health care facility as defined in section 135C.1, shall not
1 11 be required to obtain a separate Iowa controlled substances
1 12 registration upon provision to the board of proof of
1 13 controlled substances registration with the United States
1 14 department of justice, drug enforcement administration.
1 15 Controlled substances registration numbers obtained from the
1 16 United States department of justice, drug enforcement
1 17 administration, and provided under this subsection shall not
1 18 be public information but may be shared by the board for
1 19 investigative and regulatory purposes if necessary and only
1 20 under appropriate circumstances to ensure against any
1 21 unauthorized access to the information. For the purposes of
1 22 this subsection, "health care provider" means a person who is
1 23 licensed, certified, or otherwise authorized by the law of
1 24 this state to administer health care in the ordinary course of
1 25 business or practice of a profession.
1 26 EXPLANATION
1 27 This bill provides that health care providers, hospitals,
1 28 and health care facilities are not required to obtain a
1 29 separate Iowa controlled substances registration upon
1 30 providing proof to the board of pharmacy examiners of
1 31 controlled substances registration with the United States
1 32 department of justice, drug enforcement administration. The
1 33 bill also provides for confidentiality of the federal
1 34 controlled substances registration numbers obtained under the
1 35 bill. The bill defines "health care provider".
