PAG LIN 1 1 Section 1. Section 301.1, Code 2001, is amended to read as 1 2 follows: 1 3 301.1 ADOPTION PURCHASE AND SALE ACCREDITED 1 4 NONPUBLIC SCHOOL PUPIL TEXTBOOK SERVICES. 1 5 1. The board of directors of each and every school 1 6 district is hereby authorized and empowered to adopt textbooks 1 7 for the teaching of all branches that are now or may hereafter 1 8 be authorized to be taught in the public schools of the state, 1 9 and to contract for and buy said books and any and all other 1 10 necessary school supplies at said contract prices, and to sell 1 11 the same to the pupils of their respective districts at cost, 1 12 loan such textbooks to such pupils free, or rent them to such 1 13 pupils at such reasonable fee as the board shall fix, and said 1 14 money so received shall be returned to the general fund. 1 15 2. Textbooks adopted and purchased by a school district 1 16may, andshall, to the extent funds are appropriated by the 1 17 general assembly, be made available to pupils attending 1 18 accredited nonpublic schools upon request of the pupil or the 1 19 pupil's parent under comparable terms as made available to 1 20 pupils attending public schools. If the general assembly 1 21 appropriates moneys for purposes of making textbooks available 1 22 to accredited nonpublic school pupils, the department of 1 23 education shall ascertain the amount available to a school 1 24 district for the purchase of nonsectarian, nonreligious 1 25 textbooks for pupils attending accredited nonpublic schools. 1 26 The amount shall be in the proportion that the basic 1 27 enrollment of a participating accredited nonpublic school 1 28 bears to the sum of the basic enrollments of all participating 1 29 accredited nonpublic schools in the state for the budget year. 1 30 For purposes of this section, a "participating accredited 1 31 nonpublic school" means an accredited nonpublic school that 1 32 submits a written request on behalf of the school's pupils in 1 33 accordance with this subsection, and that certifies its actual 1 34 enrollment to the department of education by October 1, 1 35 annually. By October 15, annually, the department of 2 1 education shall certify to the director of revenue and finance 2 2 the annual amount to be paid to each school district, and the 2 3 director of revenue and finance shall draw warrants payable to 2 4 school districts in accordance with this subsection. For 2 5 purposes of this subsection, an accredited nonpublic school's 2 6 enrollment count shall include only students who are residents 2 7 of Iowa. The costs of providing textbooks to accredited 2 8 nonpublic school pupils as provided in this subsection shall 2 9 not be included in the computation of district cost under 2 10 chapter 257, but shall be shown in the budget as an expense 2 11 from miscellaneous income. Textbook expenditures made in 2 12 accordance with this subsection shall be kept on file in the 2 13 school district. 2 14 3. As used inthis paragraphsubsection 2, "textbooks" 2 15 means books and loose-leaf or bound manuals, systems of 2 16 reusable instructional materials or combinations of books and 2 17 supplementary instructional materials which convey information 2 18 to the student or otherwise contribute to the learning 2 19 process, or electronic textbooks, including but not limited to 2 20 computer software, applications using computer-assisted 2 21 instruction, interactive videodisc, and other computer 2 22 courseware and magnetic media. 2 23 Sec. 2. Sections 301.29 and 301.30, Code 2001, are 2 24 repealed. 2 25 EXPLANATION 2 26 This bill provides that when the general assembly 2 27 appropriates funds for textbooks for accredited nonpublic 2 28 school pupils, the department of education must determine the 2 29 amount available to a school district for the purchase of the 2 30 textbooks based upon the proportion that the basic enrollment 2 31 of a participating accredited nonpublic school bears to the 2 32 sum of the basic enrollments of all participating accredited 2 33 nonpublic schools in the state for the budget year. 2 34 The bill directs accredited nonpublic schools to submit a 2 35 written request on behalf of the school's students and to 3 1 certify their enrollments to the department by October 1 3 2 annually. 3 3 The bill directs the department to notify by October 15 3 4 annually each school district of the amount available for use 3 5 to purchase nonsectarian, nonreligious textbooks for the 3 6 participating accredited nonpublic schools. 3 7 The bill directs school districts to keep on file textbook 3 8 expenditures made for accredited nonpublic schools. 3 9 The bill repeals a provision that establishes a procedure 3 10 by which the department pays claims submitted by school 3 11 districts for the costs of providing textbook services. The 3 12 provision provides for the proration of the amounts paid to 3 13 school districts if the general assembly does not provide 3 14 sufficient funds. 3 15 LSB 5856SV 79 3 16 kh/pj/5
