  1  1    Section 1.  Section 144.13A, Code 2001, is amended to read
  1  2 as follows:
  1  3    144.13A  FEES – USE OF FUNDS.
  1  4    1.  The state registrar shall charge the parent a ten
  1  5 dollar fee for the registration of a certificate of birth and
  1  6 a as follows:
  1  7    a.  Beginning July 1, 2002, and ending June 30, 2004, a fee
  1  8 of fifteen dollars.
  1  9    b.  Beginning July 1, 2004, a fee of twenty dollars.
  1 10    2.  The state registrar shall charge the parent a separate
  1 11 fee established under section 144.46 for a certified copy of
  1 12 the certificate.  The certified copy shall be mailed to the
  1 13 parent by the state registrar.
  1 14    3.  If the person responsible for the filing of the
  1 15 certificate of birth under section 144.13 is not the parent,
  1 16 the person is entitled to collect the fee from the parent.
  1 17 The fee shall be remitted to the state registrar.  If the
  1 18 expenses of the birth are reimbursed under the medical
  1 19 assistance program established by chapter 249A, or paid for
  1 20 under the statewide indigent patient care program established
  1 21 by chapter 255, or paid for under the obstetrical and newborn
  1 22 indigent patient care program established by chapter 255A, or
  1 23 if the parent is indigent and unable to pay the expenses of
  1 24 the birth and no other means of payment is available to the
  1 25 parent, the registration fee and certified copy fee are
  1 26 waived.  If the person responsible for the filing of the
  1 27 certificate is not the parent, the person is discharged from
  1 28 the duty to collect and remit the fee under this section if
  1 29 the person has made a good faith effort to collect the fee
  1 30 from the parent.
  1 31    4.  The fees collected by the state registrar shall be
  1 32 remitted to the treasurer of state for deposit in the general
  1 33 fund of the state.
  1 34    a.  It is the intent of the general assembly that the funds
  1 35 generated from the registration fees be appropriated and used
  2  1 as follows:
  2  2    (1)  Beginning July 1, 2002, and ending June 30, 2004, ten
  2  3 dollars of each fee for primary and secondary child abuse
  2  4 prevention programs, and five dollars of each fee for the
  2  5 birth defects institute central registry established pursuant
  2  6 to section 136A.6.
  2  7    (2)  Beginning July 1, 2004, ten dollars of each fee for
  2  8 primary and secondary child abuse prevention programs, and ten
  2  9 dollars of each fee for the birth defects institute central
  2 10 registry established pursuant to section 136A.6.
  2 11    b.  It is the intent of the general assembly that the funds
  2 12 generated from the fees as established under section 144.46
  2 13 for the mailing of the certified copy of the birth certificate
  2 14 be appropriated and used to support the distribution of the
  2 15 automatic birth certificate and the implementation of the
  2 16 electronic birth certificate system.  
  2 17                           EXPLANATION
  2 18    This bill increases the fee for the registration of a birth
  2 19 certificate to $15 beginning July 1, 2002, and ending June 30,
  2 20 2004, and to $20 beginning July 1, 2004, in order to provide
  2 21 funding for the birth defects institute central registry.
  2 22 Currently the fee for registration of a birth certificate is
  2 23 $10 and the funds generated from collection of the fees are
  2 24 used for primary and secondary child abuse prevention
  2 25 programs.  Under the bill, during the period from July 1,
  2 26 2002, until June 30, 2004, of the $15 fee, $10 would still be
  2 27 used to fund primary and secondary child abuse prevention
  2 28 programs and the increase of $5 would be used to fund the
  2 29 birth defects institute central registry.  Under the bill,
  2 30 beginning July 1, 2004, of the $20 fee, $10 would still be
  2 31 used to fund primary and secondary child abuse prevention
  2 32 programs and the increase of $10 would be used to fund the
  2 33 birth defects institute central registry.
