PAG LIN 1 1 Section 1. NEW SECTION. 139A.8A CHILD IMMUNIZATION 1 2 REPORTING SYSTEM. 1 3 1. A child immunization reporting system is established in 1 4 the department to collect, store, analyze, release, and report 1 5 immunization data of minor children residing in the state. 1 6 2. Beginning on January 1, 2003, a health care provider, 1 7 local board or local department, or any other entity that 1 8 provides immunizations to minor children residing in the 1 9 state, shall report the following information to the 1 10 department: 1 11 a. The name, business address, and business telephone 1 12 number of the health care provider, local board or local 1 13 department, or other entity. 1 14 b. The name, address, social security number if known, 1 15 gender, date of birth, and mother's maiden name of the child 1 16 immunized. 1 17 c. The type of vaccine administered and the date it was 1 18 administered or that a minor child did not receive 1 19 immunizations recommended by the department pursuant to 1 20 section 139A.8 and the reason that the minor child was not 1 21 immunized. 1 22 3. The health care provider, local board or local 1 23 department, or other entity that provides immunizations to 1 24 minor children residing in the state shall submit the 1 25 information required to be reported under subsection 2 to the 1 26 department on a monthly basis. The department shall adopt 1 27 rules pursuant to chapter 17A relating to the reporting of the 1 28 information. 1 29 4. The department shall release identifying information 1 30 regarding a child only to the child's health care provider, 1 31 local board or department, or other entity that provided the 1 32 immunization to the minor child, the minor child's parent or 1 33 guardian, or a school official or licensed child care center 1 34 who is authorized by law to receive and record immunization 1 35 records. The department may adopt rules pursuant to chapter 2 1 17A allowing release of immunization information to other 2 2 persons for a specified purpose. The department may release 2 3 nonidentifying summary statistics relating to the immunization 2 4 of minor children in the state to other persons upon request 2 5 or as otherwise provided by rule. 2 6 5. Information reported to the department that identifies 2 7 a minor child is confidential except as provided in subsection 2 8 4 and in section 139A.8. A person who is authorized to 2 9 receive such confidential information shall not disclose this 2 10 information to any other person. 2 11 6. A health care provider, local board or department, or 2 12 other entity that provides immunizations, that provides 2 13 information in good faith pursuant to this section is not 2 14 subject to civil or criminal liability. 2 15 EXPLANATION 2 16 This bill establishes a child immunization reporting system 2 17 in the Iowa department of public health to collect, store, 2 18 analyze, release, and report immunization data concerning all 2 19 minor children in the state. Currently, immunization and 2 20 reporting requirements only apply to the immunization of 2 21 children in certain day care facilities and who are school- 2 22 aged. 2 23 Beginning on January 1, 2003, all health care providers, 2 24 local boards or departments of health, or other entities that 2 25 administer immunizations to minor children in the state are 2 26 required to make monthly reports to the Iowa department of 2 27 public health identifying minor children who were immunized 2 28 including what vaccine was administered or that a minor child 2 29 did not receive recommended immunizations and the reason. 2 30 The bill provides that the department shall only release 2 31 information that identifies a minor child to providers of 2 32 immunizations, a minor child's parent or guardian, or to a 2 33 school official or licensed child care center otherwise 2 34 authorized to receive immunization information. Otherwise, 2 35 such information is confidential although the department may, 3 1 by rule, allow release of information to other persons for 3 2 specified purposes and may release nonidentifying summaries of 3 3 data. 3 4 A person who knowingly violates the provisions of the bill 3 5 is guilty of a simple misdemeanor. A simple misdemeanor is 3 6 punishable by confinement for no more than 30 days, or a fine 3 7 of at least $50 but not more than $500, or by both. A health 3 8 care provider who repeatedly fails to file a report required 3 9 by this bill is subject to being reported to the licensing 3 10 board governing the professional activities of the individual. 3 11 LSB 6196XS 79 3 12 av/cf/24
