1 1 Section 1. Section 483A.1A, Code Supplement 2001, is
1 2 amended by adding the following new subsections:
1 3 NEW SUBSECTION. 0A. "Agricultural land" means
1 4 agricultural lands as defined in section 426.2.
1 5 NEW SUBSECTION. 6A. "Nonresident landowner" means a
1 6 nonresident who owns agricultural land in this state and shows
1 7 proof of ownership of the agricultural land by submitting to
1 8 the department a copy of the current annual county
1 9 consolidated property tax statement for the agricultural land
1 10 that shows ownership by the nonresident or other supporting
1 11 documentation that shows ownership by the nonresident.
1 12 Sec. 2. Section 483A.7, Code Supplement 2001, is amended
1 13 by adding the following new subsection:
1 14 NEW SUBSECTION. 4. Upon payment of a nonresident wild
1 15 turkey hunting license fee and a wildlife habitat fee, the
1 16 department shall issue a nonresident wild turkey hunting
1 17 license to a nonresident landowner. If the agricultural land
1 18 is owned jointly by more than one nonresident, only one
1 19 nonresident landowner shall be issued a nonresident wild
1 20 turkey hunting license in the same year pursuant to this
1 21 subsection. A nonresident landowner who owns agricultural
1 22 land jointly with a resident does not qualify for a wild
1 23 turkey hunting license pursuant to this subsection. The
1 24 annual limitation on the number of nonresident wild turkey
1 25 licenses issued as specified in subsection 3 does not apply to
1 26 the nonresident wild turkey licenses issued pursuant to this
1 27 subsection.
1 28 Sec. 3. Section 483A.8, Code Supplement 2001, is amended
1 29 by adding the following new subsection:
1 30 NEW SUBSECTION. 6. Upon payment of a nonresident deer
1 31 hunting license fee and a wildlife habitat fee, the department
1 32 shall issue a nonresident deer hunting license to a
1 33 nonresident landowner. If the agricultural land is owned
1 34 jointly by more than one nonresident, only one nonresident
1 35 landowner shall be issued a nonresident deer hunting license
2 1 in the same year pursuant to this subsection. A nonresident
2 2 landowner who owns agricultural land jointly with a resident
2 3 does not qualify for a nonresident deer hunting license
2 4 pursuant to this subsection. The annual limitation on the
2 5 number of nonresident licenses issued as specified in
2 6 subsection 3 does not apply to nonresident deer hunting
2 7 licenses issued pursuant to this subsection.
2 8 EXPLANATION
2 9 This bill provides for the issuance of a nonresident wild
2 10 turkey hunting license or a nonresident deer hunting license
2 11 to a nonresident who owns agricultural land in this state.
2 12 The nonresident applicant must pay the nonresident wild turkey
2 13 license fee or nonresident deer hunting fee, or both, and the
2 14 wildlife habitat fee. In addition, a nonresident landowner
2 15 shall also submit proof of ownership to the department by
2 16 submitting a copy of the current county consolidated property
2 17 tax statement for the agricultural land that shows the
2 18 nonresident landowner's name or submitting other supporting
2 19 documentation that shows the nonresident's ownership. If the
2 20 agricultural land is owned by more than one nonresident, only
2 21 one nonresident qualifies for the nonresident wild turkey or
2 22 deer license in the same year. If the agricultural land is
2 23 owned jointly with a resident, the nonresident owner is
2 24 disqualified from applying for a license as a nonresident
2 25 landowner. The nonresident wild turkey licenses or deer
2 26 licenses issued to nonresident landowners are not subject to
2 27 the annual limitation on issuance of such licenses.
2 28 "Agricultural land" is defined to mean agricultural lands
2 29 as provided in Code section 426.2.
