  1  1    Section 1.  Section 483A.8, subsection 3, Code Supplement
  1  2 2001, is amended to read as follows:
  1  3    3.  A nonresident hunting deer is required to have a
  1  4 nonresident hunting license and a nonresident deer license and
  1  5 must pay the wildlife habitat fee.  The commission shall
  1  6 annually limit to eight sixteen thousand five hundred licenses
  1  7 the number of nonresidents allowed to have deer hunting
  1  8 licenses.  Of the first six thousand nonresident deer licenses
  1  9 issued, not more than thirty-five percent of the licenses
  1 10 shall be bow season licenses and, after the first six thousand
  1 11 nonresident deer licenses have been issued, all additional
  1 12 licenses shall be issued for antlerless deer only.  The number
  1 13 of nonresident deer hunting licenses shall be determined as
  1 14 provided in section 481A.38.  The commission shall allocate
  1 15 the nonresident deer hunting licenses issued among the zones
  1 16 based on the populations of deer.  However, a nonresident
  1 17 applicant may request one or more hunting zones, in order of
  1 18 preference, in which the applicant wishes to hunt.  If the
  1 19 request cannot be fulfilled, the applicable fees shall be
  1 20 returned to the applicant.  The commission shall provide, by
  1 21 rule, for the distribution of eight thousand of the sixteen
  1 22 thousand nonresident deer hunting licenses to residents that
  1 23 operate bed and breakfast establishments or commercial guide
  1 24 services and to resident landowners who are actively engaged
  1 25 in farming operations and who host nonresident deer hunters.
  1 26 A nonresident applying for a deer hunting license must exhibit
  1 27 proof of having successfully completed a hunter safety and
  1 28 ethics education program as provided in section 483A.27 or its
  1 29 equivalent as determined by the department before the license
  1 30 is issued.
  1 31    Sec. 2.  Section 483A.8, subsection 5, Code Supplement
  1 32 2001, is amended to read as follows:
  1 33    5.  A nonresident owning land in this state may apply for
  1 34 one of the six remaining eight thousand nonresident deer
  1 35 licenses which are not distributed to resident businesses and
  2  1 landowners hosting nonresident deer hunters, and the
  2  2 provisions of subsection 3 shall apply.  However, if a
  2  3 nonresident owning land in this state is unsuccessful in the
  2  4 drawing, the landowner shall be given preference for one of
  2  5 the two thousand five hundred an antlerless only nonresident
  2  6 deer licenses license.  The commission shall determine, by
  2  7 rules, the number of anterless only deer licenses available to
  2  8 nonresident landowners.  A nonresident owning land in this
  2  9 state shall pay the fee for a nonresident antlerless only deer
  2 10 license and the license shall be valid to hunt on the
  2 11 nonresident's land only.  A nonresident owning land in this
  2 12 state is eligible for only one nonresident deer license
  2 13 annually.  If one or more parcels of land have multiple
  2 14 nonresident owners, only one of the nonresident owners is
  2 15 eligible for a nonresident antlerless only deer license.  If a
  2 16 nonresident jointly owns land in this state with a resident,
  2 17 the nonresident shall not be given preference for a
  2 18 nonresident antlerless only deer license.  The department may
  2 19 require proof of land ownership from a nonresident landowner
  2 20 applying for a nonresident antlerless only deer license.  
  2 21                           EXPLANATION
  2 22    This bill increases the number of annual nonresident deer
  2 23 hunting licenses from 8,000 to 16,000.  The natural resource
  2 24 commission shall provide, by rule, for the distribution of
  2 25 8,000 of the 16,000 nonresident licenses to residents who
  2 26 operate bed and breakfast establishments or commercial guide
  2 27 services and to resident landowners actively engaged in
  2 28 farming operations who host nonresident deer hunters.
  2 29    A nonresident owning land in this state may apply for one
  2 30 of the 8,000 nonresident deer hunting licenses remaining after
  2 31 the distribution to resident commercial interests and resident
  2 32 landowners hosting nonresident deer hunters.  If the
  2 33 nonresident landowner is unsuccessful in the drawing, the
  2 34 nonresident shall be given preference for an antlerless only
  2 35 nonresident deer license.  The natural resource commission
  3  1 shall determine the number of antlerless only deer hunting
  3  2 licenses which are available to nonresidents owning land in
  3  3 this state.
