1 1 Section 1. Section 257.20, Code 2001, is amended by adding
1 2 the following new subsection:
1 3 NEW SUBSECTION. 5. Notwithstanding the provisions of
1 4 section 257.19 relating to the ten percent instructional
1 5 support funding limitation, a school district with a budget
1 6 enrollment of two thousand or fewer pupils shall be eligible
1 7 for an amount of local funding for the instructional support
1 8 program in addition to the amount determined pursuant to
1 9 subsection 1. The amount of additional local funding shall be
1 10 determined by the board of directors of the school district.
1 11 The notice and public hearing provisions of section 257.18
1 12 shall apply; however, the option of a five-year board approved
1 13 local funding amount shall not be available for the additional
1 14 funding authorized in this subsection. At the hearing, or no
1 15 later than thirty days after the date of the hearing, the
1 16 board shall direct the county commissioner of elections to
1 17 submit the question of additional local funding for a period
1 18 not exceeding ten years to the registered voters of the school
1 19 district at the next regular school election or at a special
1 20 election. The election may be held simultaneously with, or
1 21 separately from, an election on the question of the amount of
1 22 local funding authorized pursuant to subsection 1. The
1 23 provisions of sections 257.18 through 257.27 applicable to a
1 24 ten-year voter-approved instructional support local funding
1 25 amount shall be applicable to local funding authorized
1 26 pursuant to this subsection. An increase in enrollment during
1 27 the period authorized for the additional local funding shall
1 28 not effect eligibility, but the additional funding authorized
1 29 under this subsection shall not be renewed if the district's
1 30 budget enrollment exceeds two thousand pupils.
1 31 EXPLANATION
1 32 This bill provides for an increase in local funding
1 33 authorization for the instructional support program in school
1 34 districts with a budget enrollment of 2,000 or fewer pupils.
1 35 The bill provides that the additional funding shall be
2 1 available notwithstanding the limitation contained in Code
2 2 section 257.19 limiting instructional support funding to no
2 3 more than 10 percent of the regular program district cost of a
2 4 school district plus the amount of a budget adjustment
2 5 pursuant to Code section 257.14. The bill provides that the
2 6 local funding amount shall be in addition to the local funding
2 7 calculated pursuant to Code section 257.19, subsection 1, and
2 8 shall be in an amount determined by the board of directors of
2 9 the school district. The bill provides that the additional
2 10 local funding shall not be authorized by board approval, but
2 11 shall be subject to the election provisions of Code section
2 12 257.18, subsection 1, for a 10-year voter-approved local
2 13 funding amount. The bill provides that the election for the
2 14 additional funding may be held simultaneously with, or
2 15 separately from, an election on the question of the amount of
2 16 local funding authorized pursuant to Code section 257.19,
2 17 subsection 1. The bill additionally provides that the
2 18 provisions of Code sections 257.18 through 257.27 applicable
2 19 to a 10-year voter-approved instructional support local
2 20 funding amount shall be applicable to the additional local
2 21 funding, and that an increase in enrollment during the period
2 22 authorized for the additional local funding shall not effect
2 23 eligibility. The bill provides, however, that the additional
2 24 funding shall not be renewed if the district's budget
2 25 enrollment exceeds 2,000 pupils.
