  1  1    Section 1.  INTERSTATE PRESCRIPTION DRUG PURCHASING
  1  2 COOPERATIVE – TASK FORCE – REPORT.
  1  3    1.  The Iowa department of public health shall convene a
  1  4 task force to determine the feasibility of establishing an
  1  5 interstate prescription drug purchasing cooperative with other
  1  6 midwestern states.
  1  7    2.  The task force shall consist of all of the following
  1  8 members:
  1  9    a.  The director of public health, or the director's
  1 10 designee.
  1 11    b.  The director of human services, or the director's
  1 12 designee.
  1 13    c.  The director of the department of elder affairs, or the
  1 14 director's designee.
  1 15    d.  The director of the department of management, or the
  1 16 director's designee.
  1 17    e.  The chairperson of the board of pharmacy examiners, or
  1 18 the chairperson's designee.
  1 19    f.  The chairperson of the board of medical examiners, or
  1 20 the chairperson's designee.
  1 21    g.  One person who is a representative of the
  1 22 pharmaceutical manufacturers, selected by the pharmaceutical
  1 23 research and manufacturers of America.
  1 24    h.  Four members of the general assembly.
  1 25    3.  a.  The legislative members of the task force shall be
  1 26 appointed by the majority leader of the senate, after
  1 27 consultation with the president of the senate and the minority
  1 28 leader of the senate, and by the speaker of the house, after
  1 29 consultation with the majority leader and the minority leader
  1 30 of the house of representatives.  The legislative appointments
  1 31 shall comply with sections 69.16 and 69.16A.  Legislative
  1 32 members shall receive compensation pursuant to section 2.10.
  1 33    b.  Members of the task force are entitled to receive
  1 34 reimbursement of actual expenses incurred in the discharge of
  1 35 their duties.  Public members of the task force are also
  2  1 eligible to receive compensation as provided in section 7E.6.
  2  2    c.  Vacancies on the task force shall be filled by the
  2  3 original appointing authority and in the manner of the
  2  4 original appointments.
  2  5    4.  The task force shall elect a chairperson.  A majority
  2  6 of the members of the board shall constitute a quorum.  A
  2  7 majority vote of those members present shall be required for
  2  8 any action of the board.  The Iowa department of public health
  2  9 shall provide staffing for the task force.
  2 10    5.  The task force shall pursue the establishment of an
  2 11 interstate prescription drug purchasing cooperative through a
  2 12 minimum of the following means:
  2 13    a.  Utilizing regional and national entities such as the
  2 14 council of state governments, the national conference of state
  2 15 legislatures, and others in establishing contact with the
  2 16 governors and legislative leaders of other midwestern states.
  2 17    b.  Contacting the governors and legislative leaders of
  2 18 other states with existing interstate purchasing cooperatives
  2 19 including the states participating in the tri-state coalition
  2 20 and the northeast legislative association on prescription drug
  2 21 prices.
  2 22    6.  The task force shall submit a report of its findings
  2 23 and recommendations regarding the establishment of an
  2 24 interstate prescription drug purchasing cooperative to the
  2 25 governor and the general assembly no later than December 15,
  2 26 2002.  
  2 27                           EXPLANATION
  2 28    This bill directs the Iowa department of public health to
  2 29 convene a task force to determine the feasibility of
  2 30 establishing an interstate prescription drug purchasing
  2 31 cooperative with other midwestern states.  Membership of the
  2 32 task force is to include the directors of public health, human
  2 33 services, elder affairs, department of management, or the
  2 34 respective director's designee; the chairpersons of the boards
  2 35 of pharmacy examiners and medical examiners, or the respective
  3  1 chairperson's designee; a representative of pharmaceutical
  3  2 manufacturers, selected by the pharmaceutical research and
  3  3 manufacturers of America; and four members of the general
  3  4 assembly.  The bill provides organizational procedures for the
  3  5 task force and directs the task force to pursue the
  3  6 establishment of an interstate prescription drug purchasing
  3  7 cooperative through utilization of regional and national
  3  8 entities such as the council of state governments and the
  3  9 national conference of state legislatures and by contacting
  3 10 the governors and legislative leaders of other states with
  3 11 existing interstate purchasing cooperatives.  The bill directs
  3 12 the task force to submit a report of its findings and
  3 13 recommendations regarding the establishment of an interstate
  3 14 prescription drug purchasing cooperative to the governor and
  3 15 the general assembly no later than December 15, 2002.
