  1  1    Section 1.  Section 607A.8, Code 2001, is amended to read
  1  2 as follows:
  1  3    607A.8  FEES AND EXPENSES FOR RELATED TO JURORS.
  1  4    Grand jurors and petit jurors in all courts shall receive
  1  5 ten fifty dollars as compensation for each day's service or
  1  6 attendance, including attendance required for the purpose of
  1  7 being considered for service, reimbursement for mileage
  1  8 expenses at the rate specified in section 602.1509 for each
  1  9 mile traveled each day to and from their residences to the
  1 10 place of service or attendance, and reimbursement for actual
  1 11 expenses of parking, as determined by the clerk.  A juror who
  1 12 is a person with a disability may receive reimbursement for
  1 13 the costs of alternate transportation from the juror's
  1 14 residence to the place of service or attendance.  A juror
  1 15 shall not receive reimbursement for mileage expenses or actual
  1 16 expenses of parking when the juror travels in a vehicle for
  1 17 which another juror is receiving reimbursement for mileage and
  1 18 parking expenses.  If an employer compensates an employee for
  1 19 each day of service or attendance under this section, the
  1 20 employer shall be reimbursed by the clerk of court.  An
  1 21 employer shall receive a reimbursement the equivalent of the
  1 22 employee's usual rate of pay for each hour of the employee's
  1 23 service or attendance up to a maximum of fifty dollars a day.
  1 24 The employer, before being reimbursed, shall provide proof to
  1 25 the clerk of court that the employee was compensated by the
  1 26 employer.
  1 27    Sec. 2.  Section 625.8, Code 2001, is amended by adding the
  1 28 following new subsection:
  1 29    NEW SUBSECTION.  1A.  The clerk of the district court shall
  1 30 tax as a court cost the total cost of reimbursement paid to
  1 31 any employer under section 607A.8.
  1 32    Sec. 3.  Section 625.8, Code 2001, is amended by adding the
  1 33 following new subsection:
  1 34    NEW SUBSECTION.  4.  Reimbursement of the costs under
  1 35 subsection 1A shall be deposited in the fund created in
  2  1 section 602.1302, subsection 3.  
  2  2                           EXPLANATION
  2  3    This bill raises the rate of compensation for grand or
  2  4 petit jurors from $10 to $50.
  2  5    The bill also provides that an employer who compensates an
  2  6 employee at the employee's usual rate of pay for each day of
  2  7 service on a grand or petit jury shall be reimbursed at a rate
  2  8 up to $50 per day, and an employee's service includes
  2  9 attendance required for the purpose of being considered for
  2 10 service.  The bill provides that the employer shall be
  2 11 reimbursed by the clerk of court up to the equivalent hourly
  2 12 pay for the employee for each hour served, up to the maximum
  2 13 of $50 per day.  The bill requires an employer to provide the
  2 14 clerk of court with proof that the employee was compensated
  2 15 for attendance or service on a jury before the employer will
  2 16 be reimbursed.
  2 17    The bill also provides that any reimbursement paid to an
  2 18 employer under this bill shall be taxed as a court cost under
  2 19 Code section 625.8.  The bill provides that any costs
  2 20 recovered by the clerk of court shall be deposited in the
  2 21 revolving fund established in Code section 602.1302.
  2 22    Current law provides that a juror be paid $10 per day for
  2 23 service.  Employers are not currently reimbursed directly by
  2 24 the court for compensating their employees for service on a
  2 25 jury.
