  1  4 RELATING TO THE CREATION OF A STATE INTERAGENCY MISSOURI
  1  5    RIVER AUTHORITY AND SPECIFYING ITS POWERS AND DUTIES.

  1  7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1  8 
  1  9    Section 1.  NEW SECTION.  28L.1  STATE INTERAGENCY MISSOURI
  1 10 RIVER AUTHORITY CREATED – DUTIES.
  1 11    1.  A state interagency Missouri river authority is
  1 12 created.  The members of the authority shall include the
  1 13 governor or the governor's designee, the secretary of
  1 14 agriculture or the secretary's designee, the chairperson of
  1 15 the utilities board or the chairperson's designee, and the
  1 16 directors of the department of natural resources, the state
  1 17 department of transportation, and the department of economic
  1 18 development or the directors' designees.  The governor shall
  1 19 serve as chairperson.  The director of the department of
  1 20 natural resources shall serve as the coordinator of the
  1 21 authority's activities and shall serve as chairperson in the
  1 22 absence of the governor.
  1 23    2.  The authority shall be responsible for representing the
  1 24 interests of this state with regard to its membership in the
  1 25 Missouri river basin association and to promote the management
  1 26 of the Missouri river in a manner that does not negatively
  1 27 impact landowners along the river or negatively impact the
  1 28 state's economy.  The Missouri river basin association is an
  1 29 interstate association of government representatives formed to
  1 30 seek consensus solutions to issues impacting the Missouri
  1 31 river basin.
  1 32    3.  The state interagency Missouri river authority shall
  1 33 not vote to approve or disapprove a substantive proposal or
  1 34 action being considered by the Missouri river basin
  1 35 association without the agreement of the directors of all four
  2  1 state departments and the chairperson of the utilities board
  2  2 who are members of the authority.  If a substantive proposal
  2  3 or action considered by the association is not approved or
  2  4 disapproved by all four directors and the chairperson of the
  2  5 utilities board, the state shall abstain from voting on the
  2  6 proposal or action.
  2  7    4.  The state interagency Missouri river authority shall
  2  8 meet regularly with stakeholder groups in this state to
  2  9 receive their recommendations before substantive proposals or
  2 10 actions are voted upon or to receive policy positions to
  2 11 submit to the Missouri river basin association.
