PAG LIN 1 1 Section 1. Section 92.5, subsection 9, paragraph c, Code 1 2 2001, is amended to read as follows: 1 3 c. Car cleaning, washing, and polishing, including the use 1 4 of power washers. Nothing in this subsection shall be 1 5 construed to include work involving the use of pits, racks or 1 6 lifting apparatus or involving the inflation of any tire 1 7 mounted on a rim equipped with a removable retaining ring. 1 8 Sec. 2. Section 92.6, subsection 6, Code 2001, is amended 1 9 to read as follows: 1 10 6. Operation or tending of hoisting apparatus or of any 1 11 power-driven machinery, other than power washers in car 1 12 cleaning, washing, and polishing, and office machines and 1 13 machines in retail, food service, and gasoline service 1 14 establishments which are specified in section 92.5 as machines 1 15 which such minors may operate in such establishments. 1 16 Sec. 3. Section 92.8, subsection 19, Code 2001, is amended 1 17 to read as follows: 1 18 19. Occupations involving exposure to lead fumes or its 1 19 compounds, or to dangerous or poisonous dyes or chemicals. 1 20 This subsection shall not be construed to include the use of 1 21 detergents, cleaners, and protectants in work involving car 1 22 cleaning, washing, and polishing if the person employed is 1 23 provided with and uses personal protective equipment as 1 24 needed. 1 25 Sec. 4. EFFECTIVE DATE. This Act, being deemed of 1 26 immediate importance, takes effect upon enactment. 1 27 EXPLANATION 1 28 This bill amends the child labor laws to provide that a 1 29 child under the age of 16 shall be permitted to use a power 1 30 washer in the permitted occupations of car cleaning, washing, 1 31 and polishing. Current Code lists as a prohibited occupation 1 32 for persons under age 18 those occupations involving exposure 1 33 to lead fumes or its compounds, or to dangerous or poisonous 1 34 dyes or chemicals. The bill exempts from this prohibition the 1 35 use of detergents, cleaners, and protectants in work involving 2 1 car cleaning, washing, and polishing if the child employed is 2 2 provided with and uses personal protective equipment as 2 3 needed. 2 4 The bill takes effect upon enactment. 2 5 LSB 5667XS 79 2 6 kh/sh/8
