1 1 Section 1. NEW SECTION. 147.57A DEFAULT OR BREACH OF
1 2 CONTRACT – STUDENT LOANS.
1 3 1. A license to practice a profession may be revoked or
1 4 suspended if the examining board for the profession in which
1 5 the person is licensed receives information from the
1 6 administering entity that the person has defaulted on a
1 7 student loan or has breached a student loan repayment contract
1 8 or scholarship contract by failing to perform the person's
1 9 service obligation under the contract. A license revoked or
1 10 suspended under this section shall not be reinstated or
1 11 reissued until the person provides the examining board with a
1 12 written release issued by the administering entity stating
1 13 that the person is making payments on the loan or is
1 14 satisfying the service requirements in accordance with an
1 15 agreement approved by the administering entity.
1 16 2. For the purpose of this section, "administering entity"
1 17 means any entity that administers a state or federal program
1 18 that provides student loans, student loan repayment contracts,
1 19 or scholarship contracts for the education of persons seeking
1 20 to practice a profession regulated under this chapter,
1 21 including, but not limited to, the health resources and
1 22 services administration of the United States department of
1 23 health and human services.
1 24 EXPLANATION
1 25 This bill provides that the license of a person to practice
1 26 a health-related profession may be revoked or suspended if the
1 27 examining board for the profession in which the person is
1 28 licensed receives information from an administering entity
1 29 that the person has defaulted on a student loan or has
1 30 breached a student loan repayment contract or scholarship
1 31 contract by failing to perform the person's service obligation
1 32 under the contract. A license revoked or suspended under the
1 33 bill is not to be reinstated or reissued until the person
1 34 provides the examining board with a written release issued by
1 35 the administering entity stating that the person is making
2 1 payments on the loan or is satisfying the service requirements
2 2 in accordance with an agreement approved by the administering
2 3 entity. For the purposes of the bill, "administering entity"
2 4 means any entity that administers a state or federal program
2 5 that provides student loans, student loan repayment contracts,
2 6 or scholarship contracts for the education of persons seeking
2 7 to practice a health-related profession, including, but not
2 8 limited to, the health resources and services administration
2 9 of the United States department of health and human services.
