PAG LIN 1 1 SENATE FILE 537 1 2 1 3 AN ACT 1 4 RELATING TO AND MAKING APPROPRIATIONS FROM THE TOBACCO 1 5 SETTLEMENT ENDOWMENT FUND AND THE HEALTHY IOWANS TOBACCO 1 6 TRUST, ESTABLISHING CERTAIN USES FOR THE APPROPRIATIONS, AND 1 7 PROVIDING EFFECTIVE DATES. 1 8 1 9 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 1 10 1 11 Section 1. HEALTHY IOWANS TOBACCO TRUST APPROPRIATIONS 1 12 TO DEPARTMENTS. There is appropriated from the healthy Iowans 1 13 tobacco trust created in section 12.65 to the following 1 14 departments for the fiscal year beginning July 1, 2001, and 1 15 ending June 30, 2002, the following amounts, or so much 1 16 thereof as is necessary, to be used for the purposes 1 17 designated: 1 18 1. To the department of human services: 1 19 a. Unless otherwise provided, to maintain the 1 20 reimbursement rate for all noninstitutional medical assistance 1 21 providers, with the exception of anesthesia and dental 1 22 services, at the rate provided under the federal Medicare 1 23 program for such providers during the fiscal year beginning 1 24 July 1, 2000, and ending June 30, 2001, as specified in 2000 1 25 Iowa Acts, chapter 1221, section 1, subsection 1, paragraph 1 26 "a", for the fiscal year July 1, 2001, through June 30, 2002, 1 27 and to continue the resource-based relative value system of 1 28 reimbursement under the medical assistance program: 1 29 .................................................. $ 8,095,718 1 30 b. To maintain the reimbursement rate at the usual and 1 31 customary rate as established in 2000 Iowa Acts, chapter 1221, 1 32 section 1, subsection 1, paragraph "b", for the fiscal year 1 33 July 1, 2001, through June 30, 2002, for dental services under 1 34 the medical assistance program: 1 35 .................................................. $ 3,814,973 2 1 c. To maintain the cost-of-living adjustment as 2 2 established in 2000 Iowa Acts, chapter 1221, section 1, 2 3 subsection 1, paragraph "c", for the fiscal year July 1, 2001, 2 4 through June 30, 2002, for rehabilitative treatment and 2 5 support services providers under child and family services: 2 6 .................................................. $ 3,243,026 2 7 d. To maintain the cost-of-living adjustment as 2 8 established in 2000 Iowa Acts, chapter 1221, section 1, 2 9 subsection 1, paragraph "d", for the fiscal year July 1, 2001, 2 10 through June 30, 2002, for adoption, independent living, 2 11 shelter care, and home studies services providers: 2 12 .................................................. $ 468,967 2 13 e. To maintain the reimbursement rate as established in 2 19 2000 Iowa Acts, chapter 1221, section 1, subsection 1, 2 20 paragraph "f", for the fiscal year July 1, 2001, through June 2 21 30, 2002, for home health care services under the medical 2 22 assistance program: 2 23 .................................................. $ 2,108,279 2 24 g. To maintain the reimbursement rate as established in 2 25 2000 Iowa Acts, chapter 1221, section 1, subsection 1, 2 26 paragraph "g", for the fiscal year July 1, 2001, through June 2 27 30, 2002, for critical access hospitals under the medical 2 28 assistance program: 2 29 .................................................. $ 250,000 2 30 h. To maintain the expansion of home health care services 2 31 and habilitative day care as established in 2000 Iowa Acts, 2 32 chapter 1221, section 1, subsection 1, paragraph "h", under 2 33 the medical assistance program for children with special 2 34 needs: 2 35 .................................................. $ 1,975,496 3 1 i. To maintain the expansion of respite care services 3 2 provided through home and community-based waivers as 3 3 established in 2000 Iowa Acts, chapter 1221, section 1, 3 4 subsection 1, paragraph "i", under the medical assistance 3 5 program: 3 6 .................................................. $ 1,137,309 3 7 j. To maintain the reimbursement rate as established in 3 8 2000 Iowa Acts, chapter 1221, section 1, subsection 1, 3 9 paragraph "j", for the fiscal year July 1, 2001, through June 3 10 30, 2002, to service providers under the purview of the 3 11 department of human services: 3 12 .................................................. $ 545,630 3 13 2. To the department of human services to continue the 3 14 supplementation of the children's health insurance program 3 15 appropriation: 3 16 .................................................. $ 200,000 3 17 3. To the department of human services to continue the 3 18 supplementation of the medical assistance appropriation: 3 19 .................................................. $ 7,500,000 3 20 4. To the department of human services to provide coverage 3 21 under the medical assistance program to women who require 3 22 treatment for breast or cervical cancer as provided in section 3 23 249A.3, subsection 2, paragraph "aa": 3 24 .................................................. $ 250,000 3 25 5. To the Iowa department of public health: 3 26 a. For the tobacco use prevention and control initiative, 3 27 including efforts at the state and local levels, as provided 3 28 in chapter 142A and for not more than the following full-time 3 29 equivalent positions: 3 30 .................................................. $ 9,345,394 3 31 ............................................... FTEs 7.00 3 32 (1) The director of public health shall dedicate 3 33 sufficient resources to promote and ensure retailer compliance 3 34 with tobacco laws and ordinances relating to persons under 18 3 35 years of age, and shall prioritize the state's compliance in 4 1 the allocation of available funds to comply with 42 U.S.C. } 4 2 300X-26 and section 453A.2. 4 3 (2) Of the full-time equivalent positions funded under 4 4 this section, two full-time equivalent positions shall be 4 5 utilized to provide for enforcement of tobacco laws, 4 6 regulations, and ordinances under a chapter 28D agreement 4 7 entered into between the Iowa department of public health and 4 8 the alcoholic beverages division of the department of 4 9 commerce. 4 10 (3) Of the funds appropriated in this paragraph "a", not 4 11 more than $525,759 shall be expended on administration and 4 12 management of the program. 4 13 b. For additional substance abuse treatment under the 4 14 substance abuse treatment program: 4 15 .................................................. $ 11,825,000 4 16 (1) The department shall use funds appropriated in this 4 17 paragraph "b" to enhance the quality of and to expand the 4 18 capacity to provide 24-hour substance abuse treatment 4 19 programs. 4 20 (2) The department shall use funds appropriated in this 4 21 paragraph to expand the length of individual client substance 4 22 abuse treatment plans, as necessary to reduce program 4 23 recidivism. 4 24 (3) The department shall use funds appropriated in this 4 25 paragraph to share research-based best practices for treatment 4 26 with substance abuse treatment facilities. 4 27 (4) The department shall use funds appropriated in this 4 28 paragraph to develop a results-based funding approach for 4 29 substance abuse treatment services. 4 30 (5) The department shall use funds appropriated in this 4 31 paragraph to develop a program to encourage individuals who 4 32 are successfully managing their substance abuse problems to 4 33 serve as role models. 4 34 c. For the healthy Iowans 2010 plan within the Iowa 4 35 department of public health and for not more than the 5 1 following full-time equivalent positions: 5 2 .................................................. $ 2,550,000 5 3 ............................................... FTEs 4.00 5 4 (1) Of the funds appropriated in this paragraph "c", not 5 5 more than $1,250,000 shall be used for core public health 5 6 functions, including home health care and public health 5 7 nursing services, contracted through a formula by local boards 5 8 of health, to enhance disease and injury prevention services. 5 9 (2) Of the funds appropriated in this paragraph "c", not 5 10 more than $400,000 shall be used for the continuation and 5 11 support of a coordinated system of delivery of trauma and 5 12 emergency medical services. 5 13 (3) Of the funds appropriated in this paragraph "c", not 5 14 more than $437,000 shall be used for the state poison control 5 15 center. 5 16 (4) Of the funds appropriated in this paragraph "c", not 5 17 more than $300,000 shall be used for the development of 5 18 scientific and medical expertise in environmental 5 19 epidemiology. 5 20 (5) Of the funds appropriated in this paragraph "c", not 5 21 more than $81,500 shall be used to implement prevention 5 22 strategies of healthy Iowans 2010 to address the leading 5 23 causes of death in Iowa. 5 24 (6) Of the funds appropriated in this paragraph "c", not 5 25 more than $81,500 shall be used for the childhood lead 5 26 poisoning prevention program. 5 27 d. For provision of smoking cessation products as provided 5 28 in this paragraph: 5 29 .................................................. $ 75,000 5 30 The department shall award grants to free health clinics 5 31 that are tax-exempt organizations pursuant to 26 U.S.C. } 501 5 32 (c)(3) to fund the provision of smoking cessation products to 5 33 patients. The department shall adopt a methodology for the 5 34 awarding of the grants to the health clinics based upon the 5 35 order of receipt of applications. 6 1 6. To the department of corrections: 6 2 .................................................. $ 610,000 6 3 a. Of the funds appropriated in this subsection, $127,217 6 4 is allocated to the second judicial district department of 6 5 correctional services to replace expired federal funding for 6 6 day programming. 6 7 b. Of the funds appropriated in this subsection $35,359 is 6 8 allocated to the third judicial district department of 6 9 correctional services to replace expired federal funding for 6 10 the drug court program. 6 11 c. Of the funds appropriated in this subsection, $191,731 6 12 is allocated to the fourth judicial district department of 6 13 correctional services for a drug court program. 6 14 d. Of the funds appropriated in this subsection, $255,692 6 15 is allocated to the fifth judicial district department of 6 16 correctional services to replace expired funding for the drug 6 17 court program. 6 18 Sec. 2. PURCHASE OF SERVICE CONTRACT PROVIDERS 6 19 REIMBURSEMENT INCREASE. There is appropriated from the 6 20 healthy Iowans tobacco trust created in section 12.65 to the 6 21 property tax relief fund created in section 426B.1 for the 6 22 fiscal year beginning July 1, 2001, and ending June 30, 2002, 6 23 the following amount, or so much thereof as is necessary, to 6 24 be used for the purposes designated: 6 25 For assistance to the counties with limited county mental 6 26 health, mental retardation, and developmental disabilities 6 27 services fund balances which were selected in accordance with 6 28 2000 Iowa Acts, chapter 1221, section 3 to receive such 6 29 assistance in the same amount provided during the fiscal year 6 30 beginning July 1, 2000, and ending June 30, 2001, to pay 6 31 reimbursement increases in accordance with 2000 Iowa Acts, 6 32 chapter 1221, section 3: 6 33 .................................................. $ 146,750 6 34 Sec. 3. SAVINGS ACCOUNT FOR HEALTHY IOWANS 6 35 APPROPRIATIONS. There is appropriated from the savings 7 1 account for healthy Iowans created within the tobacco 7 2 settlement endowment fund created in section 12.65, Code 2001, 7 3 to the following funds and entities for the fiscal year 7 4 beginning July 1, 2001, and ending June 30, 2002, the 7 5 following amounts, or so much thereof as is necessary, to be 7 6 used for the purposes designated: 7 7 1. To the Iowa empowerment fund created in section 28.9 7 8 for deposit in the school ready children grants account and 7 9 for distribution as provided in this subsection: 7 10 .................................................. $ 1,153,250 7 11 The moneys appropriated in this subsection shall be used 7 12 along with other appropriations made to the Iowa empowerment 7 13 fund and shall be distributed as provided in 2001 Iowa Acts, 7 14 Senate File 535, if enacted by the Seventy-ninth General 7 15 Assembly, 2001 session. 7 16 2. To the Iowa department of public health to be used for 7 17 the purpose designated and for not more than the following 7 18 full-time equivalent positions: 7 19 For establishing and operating the substance abuse 7 20 treatment facility for persons on probation as created in 7 21 section 135.130 and providing staffing for the facility to be 7 22 used exclusively to provide substance abuse treatment for 7 23 persons on probation and under the supervision of the judicial 7 24 district department of correctional services: 7 25 .................................................. $ 2,000,000 7 26 ............................................... FTEs 60.00 7 27 3. Any moneys remaining in the savings account for healthy 7 28 Iowans created within the tobacco settlement endowment fund 7 29 created in section 12.65, Code 2001, on June 30, 2001, shall 7 30 be transferred to the healthy Iowans tobacco trust created in 7 31 section 12.65, as amended in this Act, to be used for the 7 32 purposes specified in that section. 7 33 Sec. 4. PRIOR YEAR NONREVERSION. Notwithstanding 2000 7 34 Iowa Acts, chapter 1221, section 5, moneys appropriated under 7 35 2000 Iowa Acts, chapter 1221, section 3, for purchase of 8 1 service contract providers which is unexpended or unencumbered 8 2 at the end of the fiscal year beginning July 1, 2000, and 8 3 ending June 30, 2001, shall be deposited in the healthy Iowans 8 4 tobacco trust created in section 12.65, as amended in this 8 5 Act, to be used for the purposes specified in that section. 8 6 Sec. 5. Section 12.65, Code 2001, is amended to read as 8 7 follows: 8 8 12.65 HEALTHY IOWANS TOBACCOSETTLEMENT ENDOWMENT FUND8 9 TRUST. 8 10 1. A healthy Iowans tobaccosettlement endowment fund8 11 trust is created in the office of the treasurer of state. 8 12After payment of litigation costs, all moneys paid to the8 13state pursuant to the master settlement agreement, as defined8 14in section 453C.1,Moneys transferred to the healthy Iowans 8 15 tobacco trust from the endowment for Iowa's health account of 8 16 the tobacco settlement trust fund established in section 8 17 12E.12 and appropriated or transferred from any other source 8 18 shall be deposited in thefundhealthy Iowans tobacco trust. 8 192. Any moneys paid to the state by the tobacco settlement8 20authority pursuant to chapter 12E shall be deposited in the8 21fund. Additionally, the state's share of the moneys which are8 22not sold to the tobacco settlement authority pursuant to8 23chapter 12E shall be deposited in the fund.8 243.2. Moneys deposited in thefundhealthy Iowans tobacco 8 25 trust shall be used only in accordance with appropriations 8 26 from thefundhealthy Iowans tobacco trust for purposes 8 27 related to health care, substance abuse treatment and 8 28 enforcement, tobacco use prevention and control, and other 8 29 purposes related to the needs of children, adults, and 8 30 families in the state. 8 314. A savings account for healthy Iowans is created within8 32the tobacco settlement endowment fund. Moneys, appropriated8 33annually, shall be deposited in the account and shall be8 34invested to provide an ongoing source of investment earnings.8 355.3. Notwithstanding section 8.33, any unexpended balance 9 1 in thefundhealthy Iowans tobacco trust at the end of the 9 2 fiscal year shall be retained in thefundtrust. 9 3 Notwithstanding section 12C.7, subsection 2, interest or 9 4 earnings on investments or time deposits of the moneys in the 9 5 healthy Iowans tobaccosettlement endowment fund, in the9 6savings account for healthy Iowans, and in any other account9 7established within the fundtrust shall be credited to the 9 8 healthy Iowans tobaccosettlement endowment fund, to the9 9savings account for healthy Iowans, or to any other account9 10established, respectivelytrust. 9 116. For the purposes of this section, "litigation costs"9 12are those costs itemized by the attorney general and submitted9 13to and approved by the attorney general.9 147.4. Moneys in thefundhealthy Iowans tobacco trust 9 15 shall be considered part of the general fund of the state for 9 16 cash flow purposes only, provided any moneys used for cash 9 17 flow purposes are returned to thefundtrust by the close of 9 18 each fiscal year. 9 19 Sec. 6. Section 135.11, Code 2001, is amended by adding 9 20 the following new subsection: 9 21 NEW SUBSECTION. 26. Establish and administer a substance 9 22 abuse treatment facility pursuant to section 135.130. 9 23 DIVISION XIII 9 24 Sec. 7. NEW SECTION. 135.130 SUBSTANCE ABUSE TREATMENT 9 25 FACILITY FOR PERSONS ON PROBATION. 9 26 1. The director shall establish and operate a facility for 9 27 the purpose of providing a structured treatment program for 9 28 persons with a substance abuse problem who are on probation 9 29 and under the supervision of a judicial district department of 9 30 correctional services. The department shall enter into an 9 31 agreement pursuant to chapter 28E with the department of 9 32 corrections for assistance in establishing security for the 9 33 facility. The department, in consultation with the department 9 34 of corrections, shall adopt rules pursuant to chapter 17A to 9 35 administer this section. The rules adopted shall include 10 1 rules related to the treatment requirements of the program. 10 2 2. A substance abuse treatment facility advisory council 10 3 is established within the department to advise and make 10 4 recommendations to the director regarding the establishment 10 5 and operation of a facility for persons with a substance abuse 10 6 problem who are on probation and to assist with the 10 7 implementation of treatment programs that are proven to be 10 8 effective for offenders. The substance abuse treatment 10 9 facility advisory council shall consist of the directors of 10 10 the eight judicial district departments of correctional 10 11 services and one representative each from the judicial branch, 10 12 the Iowa department of public health, the department of 10 13 corrections, and the governor's office of drug control policy. 10 14 3. The department, in consultation with the department of 10 15 corrections and the advisory council, shall adopt rules 10 16 pursuant to chapter 17A to establish and operate the facility. 10 17 Sec. 8. Section 136.3, subsection 7, Code 2001, is amended 10 18 to read as follows: 10 19 7. Adopt, promulgate, amend, and repeal rules and 10 20 regulations consistent with law for the protection of the 10 21 public health and prevention of substance abuse, and for the 10 22 guidance of the department. All rules which have been or are 10 23 hereafter adopted by the department shall be subject to 10 24 approval by the board. However, rules adopted by the 10 25 commission on substance abuse for section 125.7, subsections 1 10 26 and 7, and rules adopted by the department pursuant to section 10 27 135.130 are not subject to approval by the board of health. 10 28 Sec. 9. Section 249A.3, subsection 2, Code 2001, is 10 29 amended by adding the following new paragraph after paragraph 10 30 a, and renumbering the subsequent paragraph: 10 31 NEW PARAGRAPH. aa. As provided under the federal Breast 10 32 and Cervical Cancer Prevention and Treatment Act of 2000, Pub. 10 33 L. No. 106-354, women who meet all of the following criteria: 10 34 (1) Are not described in 42 U.S.C. } 1396a(a)(10)(A)(i). 10 35 (2) Have not attained age sixty-five. 11 1 (3) Have been screened for breast and cervical cancer 11 2 under the United States centers for disease control and 11 3 prevention breast and cervical cancer early detection program 11 4 established under 42 U.S.C. } 300k et seq., in accordance with 11 5 the requirements of 42 U.S.C. } 300n, and need treatment for 11 6 breast or cervical cancer. A woman is considered screened for 11 7 breast and cervical cancer under this subparagraph if the 11 8 woman is screened by any provider or entity, and the state 11 9 grantee of the United States centers for disease control and 11 10 prevention funds under Title XV of the federal Public Health 11 11 Services Act has elected to include screening activities by 11 12 that provider or entity as screening activities pursuant to 11 13 Title XV of the federal Public Health Services Act. This 11 14 screening includes but is not limited to breast or cervical 11 15 cancer screenings or related diagnostic services provided by 11 16 family planning or community health centers and breast cancer 11 17 screenings funded by the Susan G. Komen foundation which are 11 18 provided to women who meet the eligibility requirements 11 19 established by the state grantee of the United States centers 11 20 for disease control and prevention funds under Title XV of the 11 21 federal Public Health Services Act. 11 22 (4) Are not otherwise covered under creditable coverage as 11 23 defined in 42 U.S.C. } 300gg(c). 11 24 A woman who meets the criteria of this paragraph shall be 11 25 presumptively eligible for medical assistance. 11 26 Sec. 10. Section 901B.1, subsection 1, paragraph c, Code 11 27 2001, is amended by adding the following new subparagraph: 11 28 NEW SUBPARAGRAPH. (5) A substance abuse treatment 11 29 facility as established and operated by the Iowa department of 11 30 public health. 11 31 Sec. 11. Section 901B.1, subsection 4, paragraph a, Code 11 32 2001, is amended to read as follows: 11 33 a. The district department of correctional services shall 11 34 place an individual committed to it under section 907.3 to the 11 35 sanction and level of supervision which is appropriate to the 12 1 individual based upon a current risk assessment evaluation. 12 2 Placements may be to levels two and three of the corrections 12 3 continuum. The district department may, with the approval of 12 4 the Iowa department of public health and the department of 12 5 corrections, place an individual in a level three substance 12 6 abuse treatment facility established pursuant to section 12 7 135.130, to assist the individual in complying with a 12 8 condition of probation. The district department may, with the 12 9 approval of the department of corrections, place an individual 12 10 in a level four violator facility established pursuant to 12 11 section 904.207 only as a penalty for a violation of a 12 12 condition imposed under this section. 12 13 Sec. 12. 2000 Iowa Acts, chapter 1221, section 1, 12 14 subsection 1, paragraph c, is amended to read as follows: 12 15 c. To provide a cost-of-living adjustment for the fiscal 12 16 year July 1, 2000, through June 30, 2001, of 5 percent to 12 17 rehabilitative treatment and support services providersunder12 18the medical assistance programreceiving child and family 12 19 services reimbursements: 12 20 .................................................. $ 3,100,000 12 21 Sec. 13. REVERSION. Any moneys appropriated under this 12 22 Act that are unexpended or unencumbered at the end of the 12 23 fiscal year beginning July 1, 2001, and ending June 30, 2002, 12 24 shall revert to the healthy Iowans tobacco trust. 12 25 Sec. 14. REFERENCES. References in this Act to the 12 26 tobacco settlement endowment fund and to the savings account 12 27 for healthy Iowans of the tobacco settlement endowment fund 12 28 are references to the fund and the account pursuant to section 12 29 12.65, Code 2001, and, unless otherwise provided, 12 30 appropriations from the fund and the account are references to 12 31 appropriations of moneys in the fund and the account on or 12 32 before June 30, 2001, and such moneys shall remain available 12 33 for appropriation for the fiscal year beginning July 1, 2001, 12 34 and ending June 30, 2002, as provided in this Act. 12 35 Sec. 15. EFFECTIVE DATES. 13 1 1. Section 3, subsection 3, of this Act relating to 13 2 transfer of the moneys remaining in the savings account for 13 3 healthy Iowans created within the tobacco settlement endowment 13 4 fund created in section 12.65, Code 2001, on June 30, 2001, to 13 5 the healthy Iowans tobacco trust, being deemed of immediate 13 6 importance, takes effect upon enactment. 13 7 2. Section 4 of this Act, relating to nonreversion of 13 8 funds remaining unencumbered or unobligated which were 13 9 appropriated for the purchase of service contract providers, 13 10 being deemed of immediate importance, takes effect upon 13 11 enactment. 13 12 Sec. 16. CONTINGENT EFFECTIVE DATE. The section in this 13 13 Act amending section 12.65 shall take effect only if 2001 Iowa 13 14 Acts, Senate File 532 is enacted. If 2001 Iowa Acts, Senate 13 15 File 532 is not enacted, the section in this Act amending 13 16 section 12.65 shall not take effect and references in this Act 13 17 to the healthy Iowans tobacco trust are references to the 13 18 tobacco settlement endowment fund created in section 12.65, 13 19 Code 2001. If 2001 Iowa Acts, Senate File 532 is not enacted, 13 20 all moneys paid to the state pursuant to the master settlement 13 21 agreement as defined in section 453C.1 shall be deposited in 13 22 the tobacco settlement endowment fund created in section 13 23 12.65, Code 2001. 13 24 13 25 13 26 13 27 MARY E.
