  1  4 RELATING TO OPEN FEEDLOTS, BY PROVIDING FOR STANDARDS OF
  1  5    CONSTRUCTION FOR POLLUTION CONTROL STRUCTURES.

  1  7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

  1  9    Section 1.  Section 455B.161, subsection 2, paragraph b,
  1 10 Code 2001, is amended to read as follows:
  1 11    b.  A runoff control settled open feedlot effluent basin
  1 12 which that collects and stores only precipitation-induced
  1 13 runoff from an animal feeding operation in which animals are
  1 14 confined to areas which are unroofed or partially roofed and
  1 15 in which no crop, vegetation, or forage growth or residue
  1 16 cover is maintained during the period in which animals are
  1 17 confined in the operation an open feedlot.
  1 18    Sec. 2.  Section 455B.161, Code 2001, is amended by adding
  1 19 the following new subsection:
  1 20    NEW SUBSECTION.  18A.  "Open feedlot" means an unroofed or
  1 21 partially roofed animal feeding operation if crop, vegetation,
  1 22 or forage growth or residue cover is not maintained as part of
  1 23 the animal feeding operation during the period that animals
  1 24 are confined in the animal feeding operation.
  1 25    Sec. 3.  Section 455B.171, Code 2001, is amended by adding
  1 26 the following new subsections:
  1 27    NEW SUBSECTION.  23A.  "Open feedlot" means the same as
  1 28 defined in section 455B.161.
  1 29    NEW SUBSECTION.  38A.  "Settled open feedlot effluent"
  1 30 means a combination of manure, precipitation-induced runoff,
  1 31 or other runoff originating from an open feedlot after its
  1 32 settleable solids have been removed.
  1 33    NEW SUBSECTION.  38B.  "Settled open feedlot effluent
  1 34 basin" or "basin" means an impoundment which is part of an
  1 35 open feedlot, if the primary function of the impoundment is to
  2  1 collect and store settled open feedlot effluent.
  2  2    Sec. 4.  NEW SECTION.  455B.205A  CONSTRUCTION DESIGN
  2  3 STANDARDS – SETTLED OPEN FEEDLOT EFFLUENT BASINS.
  2  4    If the department requires that a settled open feedlot
  2  5 effluent basin be constructed according to design standards,
  2  6 regardless of whether the department requires the owner to be
  2  7 issued a construction permit under section 455B.200, any
  2  8 design standards for the basin shall be established by rule as
  2  9 provided in chapter 17A that exclusively account for special
  2 10 design characteristics of open feedlots and related basins,
  2 11 including but not limited to the dilute composition of settled
  2 12 open feedlot effluent as collected and stored in the basins.
  2 13    Sec. 5.  DIRECTIONS TO CODE EDITOR.  The Code editor shall
  2 14 transfer provisions of this Act amending Code chapter 455B to
  2 15 a new chapter in conformance with sections transferred
  2 16 pursuant to Senate File 2293 or House File 2468, if enacted by
  2 17 the Seventy-ninth General Assembly, 2002 Session.
