PAG LIN 1 1 SENATE FILE 479 1 2 1 3 AN ACT 1 4 RELATING TO WASTEWATER SYSTEMS, ESTABLISHING A FUND, 1 5 APPROPRIATING MONEYS FROM THE FUND, AND PROVIDING AN 1 6 EFFECTIVE DATE. 1 7 1 8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 1 9 1 10 Section 1. Section 466.7, subsection 4, Code 2001, is 1 11 amended by striking the subsection. 1 12 Sec. 2. NEW SECTION. 466.8 ON-SITE WASTEWATER SYSTEMS 1 13 ASSISTANCE PROGRAM. 1 14 The department of natural resources shall establish an on- 1 15 site wastewater assistance program for the purpose of 1 16 providing low-interest loans to homeowners residing outside 1 17 the boundaries of a city for improving on-site wastewater 1 18 disposal systems. 1 19 1. The environmental protection commission shall adopt 1 20 rules for carrying out the program including but not limited 1 21 to criteria for homeowner participation, the methods used to 1 22 provide loans, and financing terms and limits. 1 23 2. The department may make and execute agreements with 1 24 public or private entities, including lending institutions as 1 25 defined in section 12.32, as required to administer the 1 26 program. 1 27 3. Assistance provided to homeowners shall not be used to 1 28 pay the nonfederal share of the cost of any wastewater system 1 29 projects receiving grants under the federal Clean Water Act, 1 30 33 U.S.C. } 1381-1387. 1 31 4. The department shall report to the general assembly 1 32 annually on the progress of the on-site wastewater assistance 1 33 program. 1 34 Sec. 3. NEW SECTION. 466.9 ON-SITE WASTEWATER SYSTEMS 1 35 ASSISTANCE FUND. 2 1 1. An on-site wastewater systems assistance fund is 2 2 established as a separate fund in the state treasury under the 2 3 control of the department. Moneys in the fund are 2 4 appropriated to the department for the exclusive purpose of 2 5 supporting and administering the on-site wastewater systems 2 6 assistance program as established in section 466.8. 2 7 2. The fund shall consist of all of the following: 2 8 a. Moneys appropriated to the department by the general 2 9 assembly for deposit in the fund or to carry out the purposes 2 10 of the on-site wastewater systems assistance program. 2 11 b. Moneys provided to the department by the federal 2 12 government to carry out the purpose of administering the 2 13 programs, policies, and undertakings authorized in the federal 2 14 Clean Water Act, 33 U.S.C. } 1381-1387. 2 15 c. Moneys collected by the department pursuant to loan 2 16 agreements from homeowners receiving loans under the on-site 2 17 wastewater systems assistance program. 2 18 d. Any other moneys obtained or accepted by the department 2 19 for deposit in the fund. 2 20 3. a. The fund shall consist of the following accounts: 2 21 (1) The financing account which shall be used for the 2 22 exclusive purpose of providing financing to homeowners 2 23 residing outside the boundaries of a city with improving on- 2 24 site wastewater systems under the on-site wastewater systems 2 25 assistance program. 2 26 (2) The administration account which shall be used by the 2 27 department to defray expenses associated with carrying out the 2 28 on-site wastewater systems assistance program. 2 29 b. Of all moneys deposited into the fund each year, the 2 30 department shall credit at least ninety-six percent of the 2 31 moneys to the financing account and any remaining moneys to 2 32 the administration account. 2 33 4. The moneys in the fund are not considered part of the 2 34 general fund of the state, and in determining a general fund 2 35 balance shall not be included in the general fund of the 3 1 state. The moneys in the fund are not subject to section 8.33 3 2 and shall not be transferred, used, obligated, appropriated, 3 3 or otherwise encumbered except as provided in this section. 3 4 Notwithstanding section 12C.7, subsection 2, interest or 3 5 earnings on moneys deposited in the fund shall be credited to 3 6 the fund. 3 7 Sec. 4. EFFECTIVE DATE. This Act, being deemed of 3 8 immediate importance, takes effect upon enactment. 3 9 3 10 3 11 3 12 MARY E.
