1 4 CREATING A FUND FOR THE USE OF THE STATE DEPARTMENT OF
1 5 TRANSPORTATION TO PURCHASE SOYDIESEL FUEL FOR USE IN ITS
1 6 VEHICLES AND PROVIDING AN EFFECTIVE DATE.

1 8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 10 Section 1. NEW SECTION. 307.20 BIODIESEL FUEL REVOLVING
1 11 FUND.
1 12 1. A biodiesel fuel revolving fund is created in the state
1 13 treasury. The biodiesel fuel revolving fund shall be
1 14 administered by the department and shall consist of moneys
1 15 received from the sale of EPAct credits banked by the
1 16 department on the effective date of this Act, moneys
1 17 appropriated by the general assembly, and any other moneys
1 18 obtained or accepted by the department for deposit in the
1 19 fund. Moneys in the fund are appropriated to and shall be
1 20 used by the department for the purchase of biodiesel fuel for
1 21 use in department vehicles. The department shall submit an
1 22 annual report not later than January 31 to the members of the
1 23 general assembly and the legislative fiscal bureau, of the
1 24 expenditures made from the fund during the preceding fiscal
1 25 year. Section 8.33 does not apply to any moneys in the fund
1 26 and, notwithstanding section 12C.7, subsection 2, earnings or
1 27 interest on moneys deposited in the fund shall be credited to
1 28 the fund.
1 29 2. A department motor vehicle operating on biodiesel fuel
1 30 shall be affixed with a brightly visible sticker that notifies
1 31 the traveling public that the motor vehicle uses biodiesel
1 32 fuel.
1 33 3. For purposes of this section the following definitions
1 34 apply:
1 35 a. "Biodiesel fuel" means soydiesel fuel as defined in
2 1 section 159A.2.
2 2 b. "EPAct credit" means a credit issued pursuant to the
2 3 federal Energy Policy Act (EPAct), 42 U.S.C. } 13201 et seq.
2 4 Sec. 2. 2000 Iowa Acts, chapter 1018, sections 2 and 3,
2 5 are repealed.
2 6 Sec. 3. EFFECTIVE DATE. This Act, being deemed of
2 7 immediate importance, takes effect upon enactment.
