  1  1    Section 1.  Section 712.7, Code 2001, is amended to read as
  1  2 follows:
  1  3    712.7  FALSE REPORTS.
  1  4    A person who, knowing the information to be false, conveys
  1  5 or causes to be conveyed to any person any false information
  1  6 concerning the placement of any incendiary or explosive device
  1  7 or material or other destructive substance or device in any
  1  8 place where persons or property would be endangered commits a
  1  9 class "D" felony for a first offense and a class "C" felony
  1 10 for a second or subsequent offense.
  1 11    Sec. 2.  Section 712.8, Code 2001, is amended to read as
  1 12 follows:
  1 13    712.8  THREATS.
  1 14    Any person who threatens to place or attempts to place any
  1 15 incendiary or explosive device or material, or any destructive
  1 16 substance or device in any place where it will endanger
  1 17 persons or property, commits a class "D" felony for a first
  1 18 offense and a class "C" felony for a second or subsequent
  1 19 offense.  
  1 20                           EXPLANATION
  1 21    This bill makes changes to the penalties for the criminal
  1 22 offenses of false reports and threats.
  1 23    The bill provides that a person who commits the criminal
  1 24 offense of false reports or threats commits a class "C" felony
  1 25 for a second or subsequent offense.  Current law provides that
  1 26 the offenses are punishable as class "D" felonies for any
  1 27 violation, and are punishable as an offense one degree higher
  1 28 than the underlying offense if the violation is also a hate
  1 29 crime as defined in Code section 729A.2.  The application of
  1 30 the enhanced hate crime penalty under the bill could result in
  1 31 a class "B" felony charge.
  1 32    A person commits the crime of false reports when the person
  1 33 knowingly provides false information concerning the placement
  1 34 of any incendiary device or material in any place where
  1 35 persons or property would be endangered.
  2  1    A person commits the crime of threats when the person
  2  2 places or attempts to place an incendiary device or material
  2  3 in any place where persons or property would be endangered.
  2  4    A class "D" felony is punishable by confinement for no more
  2  5 than five years and a fine of at least $750 but not more than
  2  6 $7,500.  A class "C" felony is punishable by confinement for
  2  7 no more than 10 years and a fine of at least $1,000 but not
  2  8 more than $10,000.
