PAG LIN 1 1 Section 1. Section 234.38, Code 2001, is amended to read 1 2 as follows: 1 3 234.38 FOSTER CARE REIMBURSEMENT RATES. 1 4 1. The department of human services shall make 1 5 reimbursement payments directly to foster parents for services 1 6 provided to children pursuant to section 234.6, subsection 6, 1 7 paragraph "b", or section 234.35. In any fiscal year, the 1 8 reimbursement rate shall be based uponsixty-fiveseventy-five 1 9 percent of the United States department of agriculture 1 10 estimate of the cost to raise a child in the calendar year 1 11 immediately preceding the fiscal year. The department may pay 1 12 an additional stipend for a child with special needs. 1 13 2. The clothing allowance for children in family foster 1 14 care shall be two hundred fifty dollars per child per year, 1 15 plus a second clothing allowance of two hundred fifty dollars 1 16 per year shall be provided to replace lost clothing or to 1 17 address the child's growth or weight change or other special 1 18 circumstances. The clothing allowance amounts shall be 1 19 adjusted each fiscal year by the percentage increase in the 1 20 consumer price index for all urban consumers during the 1 21 calendar year which ended on December 31 prior to the 1 22 beginning of the fiscal year. 1 23 EXPLANATION 1 24 This bill relates to foster parent reimbursement and foster 1 25 care clothing allowances. Under current law, foster parent 1 26 reimbursement rates are based upon 65 percent of the United 1 27 States department of agriculture estimate of the cost to raise 1 28 a child in the calendar year immediately preceding the fiscal 1 29 year. The bill raises this percentage to 75 percent. 1 30 In addition, the bill specifies that the clothing allowance 1 31 for children in family foster care is $250 per child per year 1 32 with a second clothing allowance of $250 to be provided for 1 33 special circumstances. Currently, department of human 1 34 services administrative rules in 42 IAC 156-8 (1) allow the 1 35 foster care worker to authorize a clothing allowance of up to 2 1 $250 for any type of foster care at the time of placement. In 2 2 addition, by rule, the foster care worker may authorize a 2 3 second allowance, not more than once per calendar year, of up 2 4 to $200 for foster family care, to address special 2 5 circumstances of replacing lost clothing, or because of 2 6 unusual growth or weight change. The bill provides for 2 7 annually increasing the clothing allowance amounts based upon 2 8 the percentage increase in the consumer price index. 2 9 LSB 2941SS 79 2 10 jp/pj/5
