1 1 Section 1. Section 50.48, subsection 3, Code 2001, is
1 2 amended by adding the following new unnumbered paragraph:
1 3 NEW UNNUMBERED PARAGRAPH. The candidate requesting the
1 4 recount and the apparent winner shall select the precincts to
1 5 be recounted. If they cannot agree, all of the precincts in
1 6 the district, ward, or county shall be recounted. In the case
1 7 of a recount of a statewide office, if the candidate
1 8 requesting the recount and the apparent winner cannot agree on
1 9 the precincts or counties to be recounted, all of the
1 10 precincts in the state shall be recounted.
1 11 EXPLANATION
1 12 Current law allows the candidate requesting a recount to
1 13 specify the precincts to be recounted. This bill provides
1 14 that the candidate requesting the recount and the apparent
1 15 winner of the election must agree on the precincts to be
1 16 recounted, or, if a statewide office, the precincts or
1 17 counties to be recounted. If they cannot agree, all of the
1 18 precincts shall be recounted.
1 19 The bill applies by operation of law to primary elections.
