PAG LIN 1 1 Section 1. Section 322.2, subsection 7, Code 2001, is 1 2 amended to read as follows: 1 3 7. "Engaged in the business" means doing any of the 1 4 following acts for the purpose of the sale of motor vehicles 1 5 at retail: acquiring, selling, exchanging, holding, offering, 1 6 displaying, brokering, accepting on consignment, conducting a 1 7 retail auction, or acting as an agent for the purpose of doing 1 8 any of those acts. A person selling at retail more thansix1 9 ten motor vehicles during a twelve-month period may be 1 10 presumed to be engaged in the business. 1 11 EXPLANATION 1 12 This bill allows a person to sell at retail up to 10 motor 1 13 vehicles during a 12-month period before the person is 1 14 presumed to be engaged in the business of selling motor 1 15 vehicles at retail. Persons who are engaged in the business 1 16 of selling motor vehicles at retail are required to be 1 17 licensed as a motor vehicle dealer under Code chapter 322. 1 18 LSB 2961XS 79 1 19 nh/cf/24
