  1  1    Section 1.  NEW SECTION.  481C.4  DEER DEPREDATION PERMITS
  1  2 – FEES – RESTRICTIONS – PENALTY.
  1  3    1.  Notwithstanding section 481C.2, a landowner who incurs
  1  4 crop or nursery damage caused by deer population may apply to
  1  5 the county recorder for not more than ten deer depredation
  1  6 permits for each farm unit of eighty acres where the damage
  1  7 has occurred.  The department shall specify, by rule, a
  1  8 proportional number of permits which may be issued for farm
  1  9 units based on the size of the farm unit, damage done, and
  1 10 deer population.  The application shall specify the crops or
  1 11 nursery stock damaged, the estimated amount of damage, and the
  1 12 area of the farm unit where the damage occurred.  Each
  1 13 application shall also be accompanied by a fee of twenty-five
  1 14 dollars for each deer depredation permit requested.  The
  1 15 permit is valid only from September 1 through the succeeding
  1 16 March 1 for taking a deer of either sex on the farm unit
  1 17 specified on the application.  If additional deer depredation
  1 18 damage occurs after ten deer have been taken on a farm unit,
  1 19 not more than ten additional depredation permits may be issued
  1 20 with the approval of a representative of the department for
  1 21 the same fee for each permit.  A postcard shall be issued with
  1 22 each depredation permit.  A person taking a deer with the
  1 23 depredation permit shall complete and return the postcard to
  1 24 the county recorder within ten days after taking the deer.  An
  1 25 unused depredation permit and postcard shall be returned to
  1 26 the county recorder by March 10 following the expiration of
  1 27 the depredation permit.
  1 28    2.  A landowner who has been issued a deer depredation
  1 29 permit pursuant to subsection 1 may sell or give the deer
  1 30 depredation permit to hunt on the specified farm unit to any
  1 31 person who is otherwise licensed, except for a deer license,
  1 32 to hunt in this state.  If a deer depredation permit is used
  1 33 by any person other than the landowner, the name and address
  1 34 of the user shall be legibly written on the permit and on the
  1 35 return postcard.
  2  1    3.  Except during a regular shotgun season, any bow and
  2  2 arrow or any legal firearm may be used to take a deer with a
  2  3 deer depredation permit.
  2  4    4.  A person who violates this section or a rule adopted
  2  5 under this section is guilty of a simple misdemeanor which is
  2  6 punishable as a scheduled violation under section 805.8,
  2  7 subsection 5, paragraph "e".
  2  8    Sec. 2.  Section 805.8, subsection 5, paragraph e, Code
  2  9 2001, is amended to read as follows:
  2 10    e.  For violations of sections 481A.85, 481A.93, 481A.95,
  2 11 481A.120, 481A.137, 481B.5, 481C.4, 482.3, 482.9, 482.15, and
  2 12 483A.42, the scheduled fine is one hundred dollars.  
  2 13                           EXPLANATION
  2 14    This bill authorizes the owner of a farm unit which has
  2 15 incurred crop or nursery damage caused by deer population to
  2 16 apply to the county recorder for not more than 10 deer
  2 17 depredation permits for each farm unit of 80 acres where the
  2 18 damage has occurred.  The department shall specify, by rule, a
  2 19 proportional number of depredation permits which may be issued
  2 20 for farm units of varying size.  The application shall specify
  2 21 the crops or nursery stock damaged, the estimated amount of
  2 22 damage, and the area of the farm unit where the damage
  2 23 occurred.  Each application shall be accompanied by a fee of
  2 24 $25 for each depredation permit requested.  Each depredation
  2 25 permit is valid only from September 1 through the succeeding
  2 26 March 1 for taking a deer of either sex on the farm unit
  2 27 specified on the permit.  If additional damage occurs after 10
  2 28 deer have been taken on a farm unit, not more than 10
  2 29 additional depredation permits may be issued with the approval
  2 30 of a representative of the department of natural resources for
  2 31 the same fee.  A postcard shall be issued with each
  2 32 depredation permit which shall be completed and returned by
  2 33 the hunter within 10 days after taking a deer.  An unused
  2 34 depredation permit and postcard shall be returned to the
  2 35 county recorder by March 10.
  3  1    A landowner who has been issued a deer depredation permit
  3  2 may sell or give the permit to hunt on the landowner's farm
  3  3 unit to any person who is otherwise licensed, except for a
  3  4 deer license, to hunt in this state.  If a deer depredation
  3  5 permit is used by any person other than the owner of the farm
  3  6 unit, the name and address of the user shall be legibly
  3  7 written on the permit and on the return postcard.
  3  8    Except during a regular shotgun season, any bow and arrow
  3  9 or other legal firearm may be used to take deer with a deer
  3 10 depredation permit.
  3 11    A person violating the provisions of this section is guilty
  3 12 of a simple misdemeanor, which is punishable by a scheduled
  3 13 fine of $100.
