  1  1    Section 1.  Section 256D.2, Code 2001, is amended to read
  1  2 as follows:
  1  3    256D.2  PROGRAM EXPENDITURES.
  1  4    1.  A Except as provided in subsection 2, a school district
  1  5 shall expend funds received pursuant to section 256D.4 at the
  1  6 kindergarten through grade three levels to reduce class sizes
  1  7 to the state goal of seventeen students for every one teacher
  1  8 and to achieve a higher level of student success in the basic
  1  9 skills, especially reading.  In order to support these
  1 10 efforts, school districts may expend funds received pursuant
  1 11 to section 256D.4 at the kindergarten through grade three
  1 12 level on programs, instructional support, and materials that
  1 13 include, but are not limited to, the following:  additional
  1 14 licensed instructional staff; additional support for students,
  1 15 such as before and after school programs, tutoring, and
  1 16 intensive summer programs; the acquisition and administration
  1 17 of diagnostic reading assessments; the implementation of
  1 18 research-based instructional intervention programs for
  1 19 students needing additional support; the implementation of
  1 20 all-day, everyday kindergarten programs; and the provision of
  1 21 classroom teachers with intensive training programs to improve
  1 22 reading instruction and professional development in best
  1 23 practices, including but not limited to training programs
  1 24 related to instruction to increase students' phonemic
  1 25 awareness, reading abilities, and comprehension skills.
  1 26    2.  In addition to the expenditures allowed under
  1 27 subsection 1, a school district that has reduced the average
  1 28 size of the kindergarten, first, second, and third grade
  1 29 classes in the district to the state goal may expend funds
  1 30 received pursuant to section 256D.4 for teacher compensation
  1 31 reform and student achievement activities approved by the
  1 32 Seventy-ninth General Assembly or future general assemblies.  
  1 33                           EXPLANATION
  1 34    This bill allows a school district that has reduced its
  1 35 average K-3 class sizes to the state goal of 17 students for
  2  1 every one teacher to use its Iowa early intervention block
  2  2 grant program moneys for teacher compensation reform and
  2  3 student achievement activities approved by the Seventy-ninth
  2  4 General Assembly or future general assemblies.
