  1  4 ELIMINATING COURT COSTS AND FILING AND SERVICE FEES FOR
  1  5    PLAINTIFFS SEEKING RELIEF FROM DOMESTIC ABUSE.

  1  7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1  8 
  1  9    Section 1.  Section 236.3, unnumbered paragraph 2, Code
  1 10 2001, is amended by striking the unnumbered paragraph and
  1 11 inserting in lieu thereof the following:
  1 12    The filing fee and court costs for an order for protection
  1 13 under this chapter shall be waived for the plaintiff.  The
  1 14 clerk of court, the sheriff of any county in this state, and
  1 15 other law enforcement and corrections officers shall perform
  1 16 their duties relating to service of process without charge to
  1 17 the petitioner.  When an order for protection is entered by
  1 18 the court, the court may direct the defendant to pay to the
  1 19 clerk of court the plaintiff's filing fees and reasonable
  1 20 costs of service of process if the court determines the
  1 21 defendant has the ability to pay the plaintiff's fees and
  1 22 costs.
  1 23    Sec. 2.  Section 236.19, subsection 5, Code 2001, is
  1 24 amended to read as follows:
  1 25    5.  Filing and service costs in connection with foreign
  1 26 protective orders may be are waived or deferred as provided in
  1 27 section 236.3.
