  1  1    Section 1.  Section 260C.14, subsection 3, Code 2001, is
  1  2 amended to read as follows:
  1  3    3.  Have the powers and duties with respect to community
  1  4 colleges, not otherwise provided in this chapter, which are
  1  5 prescribed for boards of directors of local school districts
  1  6 by chapter 279 except that the board of directors is not
  1  7 required to prohibit the use of tobacco and the use or
  1  8 possession of alcoholic liquor or beer by any student of legal
  1  9 age under the provisions of section 279.9.  Notwithstanding
  1 10 the provisions of chapter 279, the board shall also develop
  1 11 and implement, in consultation with appropriate faculty
  1 12 representatives, tenure policies that, among other things,
  1 13 provide that faculty members who possess a permanent license
  1 14 issued under chapter 272 and who have been employed by the
  1 15 community college for not less than three years, shall be
  1 16 considered permanent, or tenured, employees.  Tenure for any
  1 17 full-time faculty member shall be determined by the end of the
  1 18 faculty member's fifth consecutive year of employment.
  1 19    Sec. 2.  Section 272.1, subsection 11, Code 2001, is
  1 20 amended to read as follows:
  1 21    11.  "School" means a school under section 280.2, a
  1 22 community college, an area education agency, and a school
  1 23 operated by a state agency for special purposes.
  1 24    Sec. 3.  Section 272.3, subsection 5, Code 2001, is amended
  1 25 by striking the subsection.
  1 26    Sec. 4.  NEW SECTION.  272.15  COMMUNITY COLLEGE LICENSURE
  1 27 REQUIREMENT – EXEMPTION.
  1 28    Effective July 1, 2002, community college faculty members
  1 29 employed by a community college to teach a postsecondary-level
  1 30 curriculum, or for remediation purposes at the postsecondary
  1 31 level, are exempt from the licensing requirements of this
  1 32 chapter.  However, an individual employed by a community
  1 33 college to teach a secondary-level curriculum under the
  1 34 provisions of section 256.7, subsection 7, or under a
  1 35 supplementary weighting plan pursuant to section 257.11,
  2  1 subsection 3, shall be considered a teacher for purposes of
  2  2 this chapter.
  2  3    Sec. 5.  Section 272.33, unnumbered paragraph 1, Code 2001,
  2  4 is amended to read as follows:
  2  5    In addition to licenses required under rules adopted
  2  6 pursuant to this chapter, an individual employed as an
  2  7 administrator, supervisor, school service person, or teacher
  2  8 by a school district, or area education agency, or community
  2  9 college, who conducts evaluations of the performance of
  2 10 individuals holding licenses under this chapter, shall possess
  2 11 an evaluator license or an evaluator endorsement appearing on
  2 12 a teaching or administrative license.  Individuals employed in
  2 13 community colleges who do not directly supervise licensed
  2 14 teaching faculty are exempt from this section.  
  2 15                           EXPLANATION
  2 16    This bill exempts community college faculty members who are
  2 17 employed to teach a postsecondary-level curriculum, or who are
  2 18 employed for remediation purposes at the postsecondary level,
  2 19 from the licensing requirements administered by the board of
  2 20 educational examiners.  However, the bill provides that an
  2 21 individual employed by a community college to teach a
  2 22 secondary-level curriculum under a sharing agreement or via
  2 23 the Iowa communications network must be licensed by the board
  2 24 of educational examiners.  The bill also directs the board of
  2 25 directors of a community college to develop and implement
  2 26 tenure policies and provides time limits for tenure
  2 27 determinations.
  2 28    The Code defines "school" for practitioner licensing
  2 29 purposes.  The bill strikes community colleges from the
  2 30 institutions listed under that definition.  The bill also
  2 31 strikes community colleges from the Code provision that
  2 32 requires an individual who conducts evaluations of licensed
  2 33 practitioners to possess an evaluator license or an evaluator
  2 34 endorsement on the individual's license.
