1 1 Section 1. Section 482.15, Code 2001, is amended to read
1 2 as follows:
1 3 482.15 PENALTIES.
1 4 A person who violates this chapter or a rule issued under
1 5 this chapter is guilty of a simple misdemeanor punishable as a
1 6 scheduled violation under section 805.8, subsection 5,
1 7 paragraph "e". However, the scheduled fine specified in
1 8 section 805.8, subsection 5, paragraph "e", does not apply to
1 9 a violation of this chapter or a rule for which another
1 10 scheduled fine is specified in section 805.8, subsection 5.
1 11 Sec. 2. Section 483A.42, Code 2001, is amended to read as
1 12 follows:
1 13 483A.42 PENALTIES.
1 14 A person who violates this chapter is guilty of a simple
1 15 misdemeanor punishable as a scheduled violation under section
1 16 805.8, subsection 5, paragraph "e". However, the scheduled
1 17 fine specified in section 805.8, subsection 5, paragraph "e",
1 18 does not apply to a violation of this chapter for which
1 19 another scheduled fine is specified in section 805.8,
1 20 subsection 5.
1 21 EXPLANATION
1 22 This bill provides that the scheduled fine of $100
1 23 specified in Code section 805.8, subsection 5, paragraph "e",
1 24 does not apply to violations of Code chapters 482 and 483A for
1 25 which another scheduled fine is specified in Code section
1 26 805.8, subsection 5.
