  1  4 RELATING TO THE STATUTE OF LIMITATIONS IN CIVIL ACTIONS ARISING
  1  5    OUT OF THE UNSAFE OR DEFECTIVE CONDITION OF AN IMPROVEMENT
  1  6    TO REAL PROPERTY.

  1  8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1  9 
  1 10    Section 1.  Section 614.1, subsection 11, Code 2001, is
  1 11 amended to read as follows:
  1 12    11.  IMPROVEMENTS TO REAL PROPERTY.  In addition to
  1 13 limitations contained elsewhere in this section, an action
  1 14 arising out of the unsafe or defective condition of an
  1 15 improvement to real property based on tort and implied
  1 16 warranty and for contribution and indemnity, and founded on
  1 17 injury to property, real or personal, or injury to the person
  1 18 or wrongful death, shall not be brought more than fifteen ten
  1 19 years after the date on which occurred the act or omission of
  1 20 the defendant alleged in the action to have been the cause of
  1 21 the injury or death.  However, this subsection does not bar an
  1 22 action against a person solely in the person's capacity as an
  1 23 owner, occupant, or operator of an improvement to real
  1 24 property.
