PAG LIN 1 1 Section 1. PRESCRIPTION DRUG ASSISTANCE PROGRAM. The Iowa 1 2 department of public health in cooperation with the department 1 3 of human services shall develop a proposal for the 1 4 establishment of a prescription drug assistance program. The 1 5 purpose of the program shall be to serve low-income persons 1 6 sixty-five years of age or older and low-income persons with 1 7 disabilities who are not eligible for medical assistance and 1 8 who require prescription drugs to treat a condition which, if 1 9 left untreated, could result in the person's admission to a 1 10 health care facility or could result in the person qualifying 1 11 for medical assistance. In developing the proposal, the Iowa 1 12 department of public health shall do all of the following: 1 13 1. Identify health conditions that require prescription 1 14 drug treatment and which if not treated may lead to admission 1 15 to a health care facility or result in qualifying for medical 1 16 assistance. 1 17 2. Identify the group of low-income persons sixty-five 1 18 years of age or older and low-income persons with disabilities 1 19 who are in most need of assistance. 1 20 3. Estimate the number of persons potentially eligible for 1 21 assistance under the program. 1 22 4. Identify appropriate limitations on levels of 1 23 assistance. 1 24 5. Estimate the cost of providing assistance and the cost 1 25 of administering the program. 1 26 6. Review existing programs in the state, including but 1 27 not limited to the program developed by the Iowa department of 1 28 public health with funds received under the federal 1 29 Consolidated Appropriations Act, 2001, H.R. 4577, review 1 30 similar programs in other states, and review federal programs 1 31 to provide coordination between and to avoid duplication of 1 32 prescription drug assistance programs available in this state. 1 33 7. Develop a simple and cost-effective system for 1 34 administering the program. 1 35 8. Develop a timetable for program implementation. 2 1 9. Explore ways to develop a public-private partnership to 2 2 provide funding for the program. 2 3 10. Conduct any other activities that will assist in the 2 4 development of a proposal. 2 5 The Iowa department of public health shall submit a 2 6 proposal to the general assembly and the governor no later 2 7 than September 1, 2001. The proposal shall include several 2 8 options for consideration. 2 9 The Iowa department of public health shall not implement 2 10 any option developed as part of the study conducted under this 2 11 Act unless, following review of the options submitted, an 2 12 option is selected and approved by a constitutional majority 2 13 of each house of the general's assembly and approved by the 2 14 governor. 2 15 EXPLANATION 2 16 This bill directs the Iowa department of public health 2 17 (DPH) in cooperation with the department of human services to 2 18 develop a proposal for a prescription drug assistance program. 2 19 The program would provide assistance to low-income persons who 2 20 are 65 years of age or older and to low-income persons with 2 21 disabilities with certain conditions. The bill directs the 2 22 DPH to consider certain items in developing the proposal and 2 23 requires the DPH to submit a proposal by September 1, 2001 to 2 24 the general assembly and the governor. The bill provides that 2 25 the department is not to implement any option developed as 2 26 part of the study conducted, unless following review of the 2 27 options submitted, an option is selected and approved by a 2 28 constitutional majority of each house go the general assembly 2 29 and approved by the governor. 2 30 LSB 1854SV 79 2 31 pf/pj/5
