  1  1    Section 1.  NEW SECTION.  514L.1  INTENT OF THE GENERAL
  1  2 ASSEMBLY.
  1  3    It is the intent of the general assembly to lessen waiting
  1  4 times for patients, decrease administrative burdens for
  1  5 pharmacies, and improve patient care by minimizing confusion,
  1  6 eliminating unnecessary paperwork, and streamlining dispensing
  1  7 of prescription products paid for by third-party payors.  This
  1  8 chapter shall be broadly applied and interpreted to effectuate
  1  9 its purpose.
  1 10    Sec. 2.  NEW SECTION.  514L.2  DEFINITIONS.
  1 11    As used in this chapter, unless the context otherwise
  1 12 requires:
  1 13    1.  "Prescription drug" means prescription drug as defined
  1 14 in section 155A.3 and includes a device as defined in section
  1 15 155A.3.
  1 16    2.  "Provider of third-party payment or prepayment of
  1 17 prescription drug expenses" means a provider of an individual
  1 18 or group policy of accident or health insurance or an
  1 19 individual or group hospital or health care service contract
  1 20 issued pursuant to chapter 509, 514, or 514A, a provider of an
  1 21 individual or group health maintenance organization contract
  1 22 issued and regulated under chapter 514B, a provider of an
  1 23 organized delivery system contract regulated under rules
  1 24 adopted by the director of public health, a provider of a
  1 25 preferred provider contract issued pursuant to chapter 514F,
  1 26 and any other entity providing health insurance or health
  1 27 benefits which provide for payment or prepayment of
  1 28 prescription drug expenses coverage subject to state insurance
  1 29 regulation.
  1 30    Sec. 3.  NEW SECTION.  514L.3  UNIFORM PRESCRIPTION DRUG
  1 31 INFORMATION CARDS.
  1 32    1.  A provider of third-party payment or prepayment of
  1 33 prescription drug expenses that issues a card or other
  1 34 technology for claims processing and an administrator of the
  1 35 payor, including, but not limited to, third-party
  2  1 administrators for self-insured plans and state-administered
  2  2 plans, shall issue to its insureds a card or other technology
  2  3 containing uniform prescription drug information.  The uniform
  2  4 prescription drug information card or technology shall be the
  2  5 format approved by the national council for prescription drug
  2  6 programs and shall include all of the required fields and
  2  7 conform to the most recent pharmacy information card or
  2  8 technology implementation guide produced by the national
  2  9 council for prescription drug programs or conform to a
  2 10 national format acceptable to the commissioner of insurance.
  2 11 If a provider includes a conditional or situational field of
  2 12 payment or prepayment, the card or other technology shall
  2 13 conform to the most recent pharmacy information card or
  2 14 technology implementation guide produced by the national
  2 15 council for prescription drug programs or shall conform to a
  2 16 national format acceptable to the commissioner of insurance.
  2 17    2.  A new uniform prescription drug information card or
  2 18 technology, as required pursuant to subsection 1, shall be
  2 19 issued by a provider of third-party payment or prepayment upon
  2 20 enrollment and reissued upon any change in the certificate
  2 21 holder's coverage that impacts data contained on the card or
  2 22 technology or upon any change in the national council for
  2 23 prescription drug program implementation guide or successor
  2 24 document, provided that the change affects data elements
  2 25 contained on the card.  Newly issued cards or technology shall
  2 26 be updated with the latest coverage.  
  2 27                           EXPLANATION 
  2 28    This bill requires the use of a uniform prescription drug
  2 29 card or technology by providers of third-party payment or
  2 30 prepayment of prescription drug expenses.  The format for the
  2 31 card or technology is to be the format approved by the
  2 32 national council for prescription drug programs or a national
  2 33 format approved by the commissioner of insurance.  The uniform
  2 34 card or technology is to be issued upon enrollment and
  2 35 reissued at any time that changes in the national format take
  3  1 place.
