  1  1    Section 1.  NEW SECTION.  321.447  YOUTHS RIDING IN
  1  2 UNENCLOSED AREA NOT INTENDED FOR PASSENGERS PROHIBITED.
  1  3    The operator of a motor vehicle shall not allow a person
  1  4 under sixteen years of age to ride in an unenclosed area of a
  1  5 motor vehicle not designed or intended for passenger seating
  1  6 when the motor vehicle is in motion.  This section does not
  1  7 apply in any of the following circumstances:
  1  8    1.  The motor vehicle is operated in a parade authorized by
  1  9 proper permit from local authorities.
  1 10    2.  The person under sixteen years of age is riding in the
  1 11 motor vehicle in order to perform duties associated with the
  1 12 person's employment or to perform agricultural duties.
  1 13    3.  The motor vehicle is an authorized emergency vehicle.
  1 14    Sec. 2.  Section 321.455, Code 2001, is amended to read as
  1 15 follows:
  1 16    321.455  PROJECTING LOADS ON PASSENGER VEHICLES.
  1 17    No A passenger-type vehicle shall not be operated on any
  1 18 highway with any load carried thereon on the vehicle extending
  1 19 beyond the line of the fenders on the left side of such
  1 20 vehicle nor or extending more than six inches beyond the line
  1 21 of the fenders on the right side thereof of such vehicle.
  1 22 Passengers shall not ride on any part of any vehicle unless it
  1 23 is expressly designed either for passenger use or designed for
  1 24 carrying livestock, merchandise, or freight.
  1 25    Sec. 3.  Section 805.8, subsection 2, Code 2001, is amended
  1 26 by adding the following new paragraph:
  1 27    NEW PARAGRAPH.  aj.  For allowing a person under sixteen
  1 28 years of age to ride in an unenclosed area of a motor vehicle
  1 29 not designed or intended for passenger seating in violation of
  1 30 section 321.447, the scheduled fine is twenty-five dollars.  
  1 31                           EXPLANATION
  1 32    This bill creates new Code section 321.447, which prohibits
  1 33 the operator of a motor vehicle from allowing a person under
  1 34 16 years of age to ride in an unenclosed area of a motor
  1 35 vehicle not designed or intended for passenger seating when
  2  1 the motor vehicle is in motion.  The prohibition does not
  2  2 apply to operation of the motor vehicle in an authorized
  2  3 parade, while the person under 16 is performing employment or
  2  4 agricultural duties, or if the motor vehicle is an authorized
  2  5 emergency vehicle.  A violation of the prohibition is
  2  6 punishable by a scheduled fine of $25.
  2  7    The bill also makes a corresponding amendment to Code
  2  8 section 321.455 by striking a provision prohibiting passengers
  2  9 from riding on a vehicle unless it is designed for passenger
  2 10 use or for carrying livestock, merchandise, or freight.
