  1  4 RELATING TO THE COMPOSITION OF THE MEDICAL ASSISTANCE ADVISORY
  1  5    COUNCIL.  
  1  6 
  1  7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1  8 
  1  9    Section 1.  Section 85A.20, Code 2001, is amended to read
  1 10 as follows:
  1 11    85A.20  INVESTIGATION.
  1 12    The workers' compensation commissioner may designate the
  1 13 industrial hygiene physician of the Iowa department of public
  1 14 health and two physicians selected by the dean of the
  1 15 university of Iowa college of medicine of the state university
  1 16 of Iowa, from the staff of the college, who shall be qualified
  1 17 to diagnose and report on occupational diseases.  For the
  1 18 purpose of investigating occupational diseases, the physicians
  1 19 shall have the use, without charge, of all necessary
  1 20 laboratory and other facilities of the university of Iowa
  1 21 college of medicine and of the university hospital at the
  1 22 state university of Iowa, and of the Iowa department of public
  1 23 health in performing its duties.
  1 24    Sec. 2.  Section 135.83, Code 2001, is amended to read as
  1 25 follows:
  1 26    135.83  CONTRACTS FOR ASSISTANCE WITH ANALYSES, STUDIES,
  1 27 AND DATA.
  1 28    In furtherance of the department's responsibilities under
  1 29 sections 135.76 and 135.78, the director may contract with the
  1 30 association of Iowa hospitals and health systems hospital
  1 31 association and third party payers, the Iowa health care
  1 32 facilities association and third party payers, or the Iowa
  1 33 association of homes for the aging and third party payers for
  1 34 the establishment of pilot programs dealing with prospective
  1 35 rate review in hospitals or health care facilities, or both.
  2  1 Such contract shall be subject to the approval of the
  2  2 executive council and shall provide for an equitable
  2  3 representation of health care providers, third party payers,
  2  4 and health care consumers in the determination of criterion
  2  5 for rate review.  No third party payer shall be excluded from
  2  6 positive financial incentives based upon volume of gross
  2  7 patient revenues.  No state or federal funds appropriated or
  2  8 available to the department shall be used for any such pilot
  2  9 program.
  2 10    Sec. 3.  Section 142C.2, subsection 6, Code 2001, is
  2 11 amended to read as follows:
  2 12    6.  "Enucleator" means an individual who is certified by
  2 13 the department of ophthalmology of the university of Iowa
  2 14 college of medicine of the university of Iowa, or by the eye
  2 15 bank association of America to remove or process eyes or parts
  2 16 of eyes.
  2 17    Sec. 4.  Section 142C.16, subsection 1, paragraph c, Code
  2 18 2001, is amended to read as follows:
  2 19    c.  The association of Iowa hospitals and health systems
  2 20 hospital association.
  2 21    Sec. 5.  Section 147A.2, unnumbered paragraph 1, Code 2001,
  2 22 is amended to read as follows:
  2 23    An EMS advisory council shall be appointed by the director.
  2 24 Membership of the council shall be comprised of individuals
  2 25 nominated from, but not limited to, the following state or
  2 26 national organizations:  Iowa osteopathic medical association,
  2 27 Iowa medical society, American college of emergency
  2 28 physicians, Iowa physician assistant society, Iowa academy of
  2 29 family physicians, university of Iowa hospitals and clinics,
  2 30 Iowa EMS association, Iowa firemen's association, Iowa
  2 31 professional firefighters, EMS education programs committee,
  2 32 EMS regional council, Iowa nurses association, association of
  2 33 Iowa hospitals and health systems hospital association, and
  2 34 the Iowa state association of counties.
  2 35    Sec. 6.  Section 147A.24, subsection 1, paragraphs i and j,
  3  1 Code 2001, are amended to read as follows:
  3  2    i.  Association of Iowa hospitals and health systems
  3  3 hospital association representing rural hospitals.
  3  4    j.  Association of Iowa hospitals and health systems
  3  5 hospital association representing urban hospitals.
  3  6    Sec. 7.  Section 148D.1, subsection 2, Code 2001, is
  3  7 amended to read as follows:
  3  8    2.  "College of medicine" means the university of Iowa
  3  9 college of medicine at the state University of Iowa.
  3 10    Sec. 8.  Section 206.23, subsection 1, paragraph b, Code
  3 11 2001, is amended to read as follows:
  3 12    b.  The dean, university of Iowa college of medicine,
  3 13 University of Iowa, or the dean's designee;
  3 14    Sec. 9.  Section 225.2, Code 2001, is amended to read as
  3 15 follows:
  3 16    225.2  NAME – LOCATION.
  3 17    It shall be known as the state psychiatric hospital, and
  3 18 shall be located at Iowa City, and integrated with the
  3 19 university of Iowa college of medicine and university hospital
  3 20 of the state university of Iowa.
  3 21    Sec. 10.  Section 225.30, Code 2001, is amended to read as
  3 22 follows:
  3 23    225.30  BLANKS – AUDIT.
  3 24    The medical faculty of the hospital of the university of
  3 25 Iowa college of medicine of the state University of Iowa shall
  3 26 prepare blanks containing such questions and requiring such
  3 27 information as may be necessary and proper to be obtained by
  3 28 the physician who examines a person or respondent whose
  3 29 referral to the state psychiatric hospital is contemplated.  A
  3 30 judge may request that a physician who examines a respondent
  3 31 as required by section 229.10 complete such blanks in
  3 32 duplicate in the course of the examination.  A physician who
  3 33 proposes to file an information under section 225.10 shall
  3 34 obtain and complete such blanks in duplicate and file them
  3 35 with the information.  The blanks shall be printed by the
  4  1 state and a supply thereof shall be sent to the clerk of each
  4  2 district court of the state.  The director of revenue and
  4  3 finance shall audit, allow, and pay the cost of the blanks as
  4  4 other bills for public printing are allowed and paid.
  4  5    Sec. 11.  Section 225.33, Code 2001, is amended to read as
  4  6 follows:
  4  7    225.33  DEATH OF PATIENT – DISPOSAL OF BODY.
  4  8    In the event that a committed public patient or a voluntary
  4  9 public patient or a committed private patient should die while
  4 10 at the state psychiatric hospital or at the general university
  4 11 hospital of the college of medicine of the state University of
  4 12 Iowa, the state psychiatric hospital shall have the body
  4 13 prepared for shipment in accordance with the rules prescribed
  4 14 by the state board of health for shipping such bodies; and it
  4 15 shall be the duty of the state board of regents to make
  4 16 arrangements for the embalming and such other preparation as
  4 17 may be necessary to comply with the rules and for the purchase
  4 18 of suitable caskets.
  4 19    Sec. 12.  Section 225B.3, subsection 1, paragraphs b, c,
  4 20 and d, Code 2001, are amended to read as follows:
  4 21    b.  Three providers of disability prevention services,
  4 22 recommended by the Iowa governor's planning council for
  4 23 developmental disabilities council, appointed by the governor,
  4 24 and confirmed by the senate.
  4 25    c.  Three persons with expertise in priority prevention
  4 26 areas, recommended by the Iowa governor's planning council for
  4 27 developmental disabilities council, appointed by the governor,
  4 28 and confirmed by the senate.
  4 29    d.  Three persons with disabilities or family members of a
  4 30 person with disabilities, recommended by the Iowa governor's
  4 31 planning council for developmental disabilities council,
  4 32 appointed by the governor and confirmed by the senate.
  4 33    Sec. 13.  Section 225B.7, subsection 2, unnumbered
  4 34 paragraph 1, Code 2001, is amended to read as follows:
  4 35    The council shall, during the fiscal year beginning July 1,
  5  1 1991, request grants from the Iowa governor's planning council
  5  2 for developmental disabilities council and from private
  5  3 foundations to defray a minimum of seventy-five percent of the
  5  4 costs of implementation of this chapter.  The funds shall be
  5  5 used to carry out the purposes of this chapter, including but
  5  6 not limited to, any of the following purposes:
  5  7    Sec. 14.  Section 225C.6, subsection 1, paragraph k, Code
  5  8 2001, is amended to read as follows:
  5  9    k.  Coordinate activities with the Iowa governor's planning
  5 10 council for developmental disabilities council.
  5 11    Sec. 15.  Section 235C.2, subsection 8, Code 2001, is
  5 12 amended to read as follows:
  5 13    8.  A hospital administrator or the administrator's
  5 14 designee selected by the board of the association of Iowa
  5 15 hospitals and health systems hospital association.
  5 16    Sec. 16.  Section 235C.3, subsection 2, paragraph b, Code
  5 17 2001, is amended to read as follows:
  5 18    b.  A health professional training campaign, including
  5 19 recommendations concerning the curriculum offered at the
  5 20 university of Iowa college of medicine at the state university
  5 21 of Iowa and Des Moines university – osteopathic medical
  5 22 center, providing assistance in the identification of women at
  5 23 risk of substance abuse during pregnancy and strategies to be
  5 24 employed in assisting those women to maintain healthy
  5 25 lifestyles during pregnancy.  This education campaign shall
  5 26 offer information to health professionals on assessment,
  5 27 laboratory testing, and referrals.
  5 28    Sec. 17.  Section 249A.4, subsection 8, unnumbered
  5 29 paragraph 1, Code 2001, is amended to read as follows:
  5 30    Shall advise and consult at least semiannually with a
  5 31 council composed of the presidents of the following
  5 32 organizations, or a president's representative who is a member
  5 33 of the organization represented by the president:  the Iowa
  5 34 medical society, the Iowa osteopathic medical association, the
  5 35 Iowa academy of family physicians, the Iowa chapter of the
  6  1 American academy of pediatrics, the Iowa physical therapy
  6  2 association, the Iowa state dental society association, the
  6  3 Iowa state nurses association, the Iowa pharmacists pharmacy
  6  4 association, the Iowa podiatry podiatric medical society, the
  6  5 Iowa optometric association, the Iowa association of community
  6  6 providers, the Iowa psychological association, the Iowa
  6  7 psychiatric society, the Iowa chapter of the national
  6  8 association of social workers, the association of Iowa
  6  9 hospitals and health systems hospital association, the Iowa
  6 10 association of rural health clinics, the Iowa osteopathic
  6 11 hospital association, opticians' association of Iowa, inc.,
  6 12 the Iowa association of hearing aid society health
  6 13 professionals, the Iowa speech, language, and hearing
  6 14 association, the Iowa health care association, the Iowa
  6 15 association for home care, the Iowa council of health care
  6 16 centers, the Iowa physician assistant society, the Iowa
  6 17 association of nurse practitioners, the Iowa occupational
  6 18 therapy association, and the Iowa association of homes and
  6 19 services for the aging, the arc of Iowa which was formerly
  6 20 known as the association for retarded citizens of Iowa, the
  6 21 alliance for the mentally ill of Iowa, Iowa state association
  6 22 of counties, and the Iowa governor's planning council for
  6 23 developmental disabilities council, together with one person
  6 24 designated by the Iowa state board of chiropractic examiners
  6 25 society; one state representative from each of the two major
  6 26 political parties appointed by the speaker of the house, one
  6 27 state senator from each of the two major political parties
  6 28 appointed by the president of the senate, after consultation
  6 29 with the majority leader and the minority leader of the
  6 30 senate, each for a term of two years; four public
  6 31 representatives, appointed by the governor for staggered terms
  6 32 of two years each, none of whom shall be members of, or
  6 33 practitioners of, or have a pecuniary interest in any of the
  6 34 professions or businesses represented by any of the several
  6 35 professional groups and associations specifically represented
  7  1 on the council under this subsection, and at least one of whom
  7  2 shall be a recipient of medical assistance; the director of
  7  3 public health, or a representative designated by the director;
  7  4 the dean of Des Moines university–osteopathic medical center,
  7  5 or a representative designated by the dean; and the dean of
  7  6 the college of medicine, university of Iowa college of
  7  7 medicine, or a representative designated by the dean.
  7  8    Sec. 18.  Section 255.29, Code 2001, is amended to read as
  7  9 follows:
  7 10    255.29  MEDICAL CARE FOR PAROLEES AND PERSONS ON WORK
  7 11 RELEASE.
  7 12    The director of the Iowa department of corrections may send
  7 13 former inmates of the institutions provided for in section
  7 14 904.102, while on parole or work release, to the hospital of
  7 15 the university of Iowa college of medicine of the state
  7 16 University of Iowa for treatment and care as provided in this
  7 17 chapter, without securing the order of the court required in
  7 18 other cases.  The director may pay the traveling expenses of
  7 19 any patient thus committed, and when necessary the traveling
  7 20 expenses of an attendant of the patient out of funds
  7 21 appropriated for the use of the department.
  7 22    Sec. 19.  Section 263.17, subsection 2, paragraph a,
  7 23 subparagraph (2), Code 2001, is amended to read as follows:
  7 24    (2)  The state university of Iowa department of pediatrics
  7 25 of the university of Iowa college of medicine.
  7 26    Sec. 20.  Section 691.5, Code 2001, is amended to read as
  7 27 follows:
  7 28    691.5  STATE MEDICAL EXAMINER.
  7 29    The office and position of state medical examiner is
  7 30 established for administrative purposes within the Iowa
  7 31 department of public health.  Other state agencies shall
  7 32 cooperate with the state medical examiner in the use of state-
  7 33 owned facilities when appropriate for the performance of
  7 34 nonadministrative duties of the state medical examiner.  The
  7 35 state medical examiner shall be a physician and surgeon or
  8  1 osteopathic physician and surgeon, be licensed to practice
  8  2 medicine in the state of Iowa, and be board certified or
  8  3 eligible to be board certified in anatomic and forensic
  8  4 pathology by the American board of pathology.  The state
  8  5 medical examiner shall be appointed by and serve at the
  8  6 pleasure of the director of public health upon the advice of
  8  7 and in consultation with the director of public safety and the
  8  8 governor.  The state medical examiner, in consultation with
  8  9 the director of public health, shall be responsible for
  8 10 developing and administering the medical examiner's budget and
  8 11 for employment of medical examiner staff and assistants.  The
  8 12 state medical examiner may be a faculty member of the
  8 13 university of Iowa college of medicine or the college of law
  8 14 at the university of Iowa, and any of the examiner's
  8 15 assistants or staff may be members of the faculty or staff of
  8 16 the university of Iowa college of medicine or the college of
  8 17 law at the university of Iowa.
  8 18    Sec. 21.  Section 691.6A, Code 2001, is amended to read as
  8 19 follows:
  8 20    691.6A  DEPUTY STATE MEDICAL EXAMINER – CREATION AND
  8 21 DUTIES.
  8 22    The position of deputy state medical examiner is created
  8 23 within the office of the state medical examiner.  The deputy
  8 24 state medical examiner shall report to and be responsible to
  8 25 the state medical examiner.  The deputy state medical examiner
  8 26 shall meet the qualification criteria established in section
  8 27 691.5 for the state medical examiner and shall be subject to
  8 28 rules adopted by the state medical examiner as provided in
  8 29 section 691.6, subsection 3.  The state medical examiner and
  8 30 the deputy state medical examiner shall function as a team,
  8 31 providing peer review as necessary, fulfilling each other's
  8 32 job responsibilities during times of absence, and working
  8 33 jointly to provide services and education to county medical
  8 34 examiners, law enforcement officials, hospital pathologists,
  8 35 and other individuals and entities.  The deputy medical
  9  1 examiner may be, but is not required to be, a full-time
  9  2 salaried faculty member of the department of pathology of the
  9  3 university of Iowa college of medicine at the university of
  9  4 Iowa.  If the medical examiner is a full-time salaried faculty
  9  5 member of the department of pathology of the university of
  9  6 Iowa college of medicine at the university of Iowa, the Iowa
  9  7 department of public health and the state board of regents
  9  8 shall enter into a chapter 28E agreement to define the
  9  9 activities and functions of the deputy medical examiner, and
  9 10 to allocate deputy medical examiner costs, consistent with the
  9 11 requirements of this section.
