1 1 Section 1. Section 68B.31, Code 2001, is amended by adding
1 2 the following new subsection:
1 3 NEW SUBSECTION. 9A. The ethics committee of each house
1 4 shall recommend rules for adoption by the respective house
1 5 relating to special confidentiality rules for ethics
1 6 complaints filed on or after May 1 of each even-numbered year.
1 7 The rules shall provide for a complaint, any information
1 8 accompanying the complaint, and any procedures related to the
1 9 complaint conducted by the ethics committee or staff
1 10 subsequent to the filing of the complaint to be kept
1 11 confidential if, in the best judgment of the chairperson of
1 12 the ethics committee, a final disposition of the complaint
1 13 cannot be reached prior to election day. These rules shall
1 14 supersede any confidentiality rules adopted pursuant to
1 15 subsection 9 until the day after election day at which time
1 16 the confidentiality rules adopted pursuant to subsection 9
1 17 shall govern all complaints currently under consideration by
1 18 the ethics committee.
1 19 EXPLANATION
1 20 This bill provides for special confidentiality rules to be
1 21 adopted relating to ethics complaints filed on or after May 1
1 22 of each even-numbered year. The bill provides that the rules
1 23 shall provide for a complaint, any information accompanying
1 24 the complaint, and any procedures related to the complaint
1 25 conducted by the ethics committee or staff subsequent to the
1 26 filing of the complaint to be kept confidential if, in the
1 27 best judgment of the chairperson of the ethics committee, a
1 28 final disposition of the complaint cannot be reached prior to
1 29 election day. The bill provides that the special
1 30 confidentiality rules shall supersede any regular
1 31 confidentiality rules until the day after election day at
1 32 which time the regular ethics committee confidentiality rules
1 33 shall govern any complaints currently under consideration by
1 34 the ethics committee.
