1 1 Section 1. NEW SECTION. 321.71A NONOPERATIVE AIR BAGS.
1 2 A person shall not install or reinstall for compensation,
1 3 distribute, or sell a nonoperative air bag that is part of an
1 4 inflatable restraint system for a motor vehicle if the person
1 5 knows that the air bag is nonoperative. A violation of this
1 6 section is an aggravated misdemeanor punishable by confinement
1 7 for up to one year and a fine of at least five hundred dollars
1 8 but not more than five thousand dollars.
1 9 For purposes of this section, "nonoperative air bag"
1 10 includes an air bag that has been previously deployed, is
1 11 nonfunctional, or is otherwise defective. "Nonoperative air
1 12 bag" also includes anything that is inserted, or is intended
1 13 to be inserted, in place of an airbag, which would prohibit an
1 14 inflatable restraint system from functioning properly.
1 15 EXPLANATION
1 16 This bill prohibits a person from installing or
1 17 reinstalling for compensation, distributing, or selling a
1 18 nonoperative air bag that is part of an inflatable restraint
1 19 system for a motor vehicle if the person knows that the air
1 20 bag is nonoperative. A violation of this prohibition is an
1 21 aggravated misdemeanor punishable by confinement for no more
1 22 than one year and a fine of at least $500 but not more than
1 23 $5,000.
