  1  4 RELATING TO THE PROCESSING AND DISTRIBUTION OF HONEY IN
  1  5    RESIDENCES.  
  1  6 
  1  7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1  8 
  1  9    Section 1.  Section 137F.1, subsection 8, Code 2001, is
  1 10 amended by adding the following new paragraph:
  1 11    NEW PARAGRAPH.  m.  The premises of a residence in which
  1 12 honey is stored; prepared; packaged, including by placement in
  1 13 a container; labeled; or from which honey is distributed.
  1 14    Sec. 2.  Section 137F.1, subsection 9, Code 2001, is
  1 15 amended to read as follows:
  1 16    9.  "Food processing plant" means a commercial operation
  1 17 that manufactures, packages, labels, or stores food for human
  1 18 consumption and does not provide food directly to a consumer.
  1 19 "Food processing plant" does not include premises any of the
  1 20 following:
  1 21    a.  A premises covered by a class "A" beer permit as
  1 22 provided in chapter 123.
  1 23    b.  A premises of a residence in which honey is stored;
  1 24 prepared; packaged, including by placement in a container;
  1 25 labeled; or from which honey is distributed.
  1 26    Sec. 3.  Section 137F.2, subsection 6, Code 2001, is
  1 27 amended to read as follows:
  1 28    6.  3-201.11(B) shall be amended to allow food all of the
  1 29 following:
  1 30    a.  Food that is prepared by a home food establishment
  1 31 licensed under chapter 137D to be used or offered for sale.
  1 32    b.  Honey that is stored; prepared; packaged, including by
  1 33 placement in a container; or labeled on or distributed from
  1 34 the premises of a residence.
