  1  1    Amend the amendment, S-5437, to Senate File 2293,
  1  2 as follows:
  1  3    #1.  Page 25, lines 17 and 18, by striking the
  1  4 words "application permit" and inserting the
  1  5 following:  "permit application".
  1  6    #2.  Page 36, line 44, by inserting before the word
  1  7 "contractor" the following:  "active".
  1  8    #3.  Page 42, by inserting after line 50, the
  1  9 following:
  1 10    "Sec.    .  MANURE STORAGE INDEMNITY FUND –
  1 11 TEMPORARY TRANSFER.  Notwithstanding section 455J.2,
  1 12 the department is authorized to temporarily transfer
  1 13 any amount of the unobligated and unencumbered balance
  1 14 of the manure storage indemnity fund as provided under
  1 15 section 455J.2 to the general account of the animal
  1 16 agriculture compliance fund as created in section
  1 17 455B.127, as enacted in this Act, for use as provided
  1 18 in section 455B.127.  The department shall return the
  1 19 amount transferred under this section to the manure
  1 20 storage indemnity fund according to a schedule
  1 21 established by the department upon the collection of
  1 22 compliance fees deposited into the animal agriculture
  1 23 compliance fund pursuant to section 455B.203C.
  1 24 Notwithstanding section 455B.127, the department may
  1 25 return moneys from the assessment account of the
  1 26 animal agriculture compliance fund to the manure
  1 27 storage indemnity fund if at any time moneys are not
  1 28 sufficiently available to make the return from the
  1 29 general account of the animal agriculture compliance
  1 30 fund."
  1 31    #4.  Page 52, line 48, by striking the word
  1 32 "section" and inserting the following:  "Act".
  1 33    #5.  By renumbering as necessary.
