  1  1    Amend the amendment, S-5437, to Senate File 2293,
  1  2 as follows:
  1  3    #1.  Page 38, line 27, by striking the words "A
  1  4 confinement" and inserting the following:
  1  5    "a.  Except as provided in paragraph "b", a
  1  6 confinement".
  1  7    #2.  Page 38, by inserting after line 30, the
  1  8 following:
  1  9    "b.  A confinement feeding operation structure may
  1 10 be constructed on land that is part of a one hundred
  1 11 year floodplain if the finished floor of the
  1 12 confinement feeding operation building or the
  1 13 freeboard level of a manure storage structure is
  1 14 located at least one foot above the level of the
  1 15 floodplain's average water mark during a flood
  1 16 occurrence and the confinement feeding operation is
  1 17 constructed pursuant to all requirements of law,
  1 18 including but not limited to construction or operation
  1 19 under permit, the establishment of encroachment
  1 20 limits, floodplain regulations, and zoning ordinances.
  1 21    3A.  When constructing a confinement feeding
  1 22 operation structure, regardless of its location
  1 23 including its proximity to a water of the state, a
  1 24 monitoring system must be installed as part of the
  1 25 structure.  The system shall provide for the placement
  1 26 of tile around the perimeter of the structure's
  1 27 foundation and the placement of vertical risers in
  1 28 order to monitor possible contamination."
  1 29    #3.  By renumbering, redesignating, and correcting
  1 30 internal references as necessary.
