  1  1    Amend Senate File 2330 as follows:
  1  2    #1.  By striking everything after the enacting
  1  3 clause and inserting the following:
  1  4    "Section 1.  NEW SECTION.  331.386  REGIONAL
  1  5 TRANSIT DISTRICT AUTHORIZED – DEFINITION – FINANCE
  1  6 AUTHORITY.
  1  7    1.  DEFINITION.  As used in this section, unless
  1  8 the context otherwise requires, "regional transit
  1  9 district" means a public transit district created
  1 10 pursuant to an agreement pursuant to chapter 28E by
  1 11 one or more counties or cities to provide support for
  1 12 transportation passengers by one or more public
  1 13 transit systems designated under chapter 324A.
  1 14    2.  REGIONAL TRANSIT DISTRICT CREATED.
  1 15    a.  One or more counties may create a regional
  1 16 transit district consisting of  the area of any
  1 17 participating county outside cities served by an urban
  1 18 transit system and the incorporated area of any
  1 19 participating city.  The areas included in a regional
  1 20 transit district need not be contiguous, but the
  1 21 parties to a chapter 28E agreement creating a regional
  1 22 transit district shall include at least one county,
  1 23 plus any of the following:
  1 24    (1)  Any contiguous counties which choose to
  1 25 participate.
  1 26    (2)  Any cities which choose to participate,
  1 27 provided the cities are located within a participating
  1 28 county or within a county contiguous to a
  1 29 participating county or to a county with at least one
  1 30 participating city.
  1 31    b.  The governing body of a regional transit
  1 32 district has all the rights, powers, privileges, and
  1 33 immunities of a local government relating to the
  1 34 purpose for which the regional transit district is
  1 35 created.  In exercising its powers, the governing body
  1 36 may establish a schedule of fares and collect fares
  1 37 for the transportation of passengers.
  1 38    3.  BONDING AUTHORITY.
  1 39    a.  The establishment, construction,
  1 40 reconstruction, repair, equipping, remodeling,
  1 41 extension, maintenance, and operation of works,
  1 42 vehicles, and facilities of a regional transit
  1 43 district may be financed by revenue bonds as a county
  1 44 enterprise pursuant to division IV, part 4.
  1 45    b.  The establishment, construction,
  1 46 reconstruction, repair, equipping, remodeling,
  1 47 extension, maintenance, and operation of works,
  1 48 vehicles, and facilities of a regional transit
  1 49 district may be financed by general obligation bonds
  1 50 as an essential county purpose pursuant to division
  2  1 IV, part 3.
  2  2    Sec.    .  NEW SECTION.  331.424D  REGIONAL TRANSIT
  2  3 DISTRICT LEVY.
  2  4    The board may levy annually a tax not to exceed
  2  5 ninety-five cents per thousand dollars of the assessed
  2  6 value of all taxable property in the county within a
  2  7 regional transit district but not within the
  2  8 incorporated area of a city.  However, if a city
  2  9 participating in a regional transit district
  2 10 authorizes the board to levy a tax for the regional
  2 11 transit district within the city, the tax levy
  2 12 authorized pursuant to section 384.12, subsection 10,
  2 13 shall be reduced by the tax levy imposed by the county
  2 14 pursuant to the agreement.  A tax levy imposed
  2 15 pursuant to section 384.12, subsection 10, and this
  2 16 section shall not exceed the aggregate of ninety-five
  2 17 cents per thousand dollars of the assessed value of
  2 18 all taxable property in a participating city.  The
  2 19 proceeds of the tax levy shall be used for the
  2 20 operation and maintenance of a regional transit
  2 21 district and for the creation of a reserve fund.  The
  2 22 board may divide the territory of a regional transit
  2 23 district outside the boundaries of a city into
  2 24 separate service areas and impose a separate levy not
  2 25 to exceed the maximum rate authorized in this section
  2 26 in each service area.
  2 27    Sec.    .  Section 331.441, subsection 2, paragraph
  2 28 b, Code Supplement 2001, is amended by adding the
  2 29 following new subparagraph:
  2 30    NEW SUBPARAGRAPH.  (15)  The establishment,
  2 31 construction, reconstruction, repair, equipping,
  2 32 remodeling, extension, maintenance, and operation of
  2 33 works, vehicles, and facilities of a regional transit
  2 34 district.
  2 35    Sec.    .  Section 331.461, subsection 2, Code
  2 36 Supplement 2001, is amended by adding the following
  2 37 new paragraph:
  2 38    NEW PARAGRAPH.  h.  A regional transit district
  2 39 including the establishment, construction,
  2 40 reconstruction, repair, equipping, remodeling,
  2 41 extension, maintenance, and operation of its works,
  2 42 vehicles, and facilities.
  2 43    Sec.    .  Section 384.12, subsection 10, Code
  2 44 2001, is amended to read as follows:
  2 45    10.  A tax for the operation and maintenance of a
  2 46 municipal transit system, and for the creation of a
  2 47 reserve fund for the system, in an amount not to
  2 48 exceed ninety-five cents per thousand dollars of
  2 49 assessed value each year less the rate of tax levied
  2 50 for a regional transit district pursuant to section
  3  1 331.424D, when the revenues from the transit system
  3  2 are insufficient for such purposes, but proceeds of
  3  3 the tax may not be used to pay interest and principal
  3  4 on bonds issued for the purposes of the transit
  3  5 system."
  3  6    #2.  Title page, line 3, by inserting after the
  3  7 word "counties," the following:  "authorizing the
  3  8 imposition of a limited tax levy,".
  3  9    #3.  By renumbering as necessary.
